Ward issues document, businesses still disregard
Toan Thang Ninh Binh Trading Service Co., Ltd. (Toan Thang Ninh Binh Company) at the end of January 2026 was pointed out by the Provincial Department of Agriculture and Environment (NNMT) for a series of issues in complying with land law in the Mai Son brick factory construction project (Yen Thang ward, Ninh Binh province).
In the inspection conclusion notice, the Department of Agriculture and Environment requested Toan Thang Ninh Binh Company to immediately terminate the operation of 2 concrete mixing lines at the land plot adjacent to the expressway on the North-South route in the East and the gathering of goods at the land plot adjacent to the extended provincial road DT477.
However, according to actual records of Lao Dong Newspaper reporters at the end of March 2026 recently, Toan Thang Ninh Binh Company has not yet complied with the direction of functional agencies, blatantly continuing to operate the concrete production line, not in accordance with the approved project objectives.
It is worth mentioning that before that, on March 10, 2026, Yen Thang Ward People's Committee had a document Notice sent to Toan Thang Ninh Binh Company, requesting this enterprise: Strictly implement the contents according to the Notice of conclusion on inspection of compliance with land law of the Department of Agriculture and Rural Development; Stop the operation of 2 concrete mixing plant lines before 5:00 PM on March 15, 2026.
If Toan Thang Ninh Binh Company does not voluntarily implement it, Yen Thang Ward People's Committee will report to competent authorities for handling according to the provisions of law" - the ward's document stated.
On March 19, in an exchange with a reporter from Lao Dong Newspaper, Mr. Luu Quang Minh - Chairman of Yen Thang Ward People's Committee said that he would organize a working session with Toan Thang Ninh Binh Company, in coordination with relevant functional agencies to handle the case.
Accepting the opinions reflected in the newspaper, we will have a working conference with Departments and company representatives to have further handling measures" - Mr. Luu Quang Minh said.
Updated to the afternoon of March 25, Yen Thang Ward People's Committee said it is still taking steps to invite the business to work.
Request to inspect nearly 19,500m2 of land outside the licensed area
Regarding the content of the inspection of the Mai Son brick factory construction project of Toan Thang Ninh Binh Company, according to PV's investigation, Ninh Binh Department of Agriculture and Rural Development has proposed to the Department of Finance to consider the current operation status of the project in accordance with the law on investment.
Yen Thang Ward People's Committee is proposed to direct departments and specialized units to strengthen inspection and supervision of compliance with land laws in the process of operation for the above project. Strengthen state management of agriculture and environment in the ward; review, inspect, and consider handling the area of 19,480.2 m2 of land outside the Certificate of Land Use Rights that has been issued and has not been leased by a competent state agency that Toan Thang Ninh Binh Company is using; report the handling results to the Department of Agriculture and Rural Development in the second quarter of 2026.
Meanwhile, for Toan Thang Ninh Binh Company, in addition to immediately terminating the operation of 2 specialized concrete lines, this enterprise must urgently contact the Department of Finance to be considered for adjustment procedures for the Investment Certificate (adjusting the area serving the project, adjusting the investment scale, adjusting the project implementation progress) according to the provisions of investment law.
Immediately after the Mai Son brick factory construction project in Yen Thang ward, Ninh Binh province is approved for adjustment by competent authorities, Toan Thang Ninh Binh Company must have a document sent to Yen Thang Ward People's Committee requesting permission to extend the land use progress to implement the Project according to regulations.
At the same time, Toan Thang Ninh Binh Company must additionally pay to the State the amount corresponding to the land use fee and land rent for the extended land use progress period (if permitted by Yen Thang Ward People's Committee).
Analyzing this matter, according to lawyer Nguyen Thi Hong (Hoang Thanh Law Firm), in her opinion, for cases where they do not voluntarily implement the requests of state management agencies, functional agencies can apply coercive measures according to the provisions of the law on land and investment, and at the same time consider the responsibility of relevant organizations and individuals. Delays in handling not only affect the effectiveness of state management but also pose a potential risk of developing consequences for land management order in the locality.
