Running a red light while taking someone to the emergency room
At about 11:50 a.m. on December 25, 2024, Mr. Pham Anh Vuong (born in 1988, residing in Gia Lam, Hanoi), was driving a personal car with license plate 30G-095.xx on Vo Chi Cong Street.
At that time, there was a traffic accident on Vo Chi Cong Street. When passing by the scene, Mr. Vuong discovered an unconscious woman on the road. Without hesitation, he stopped his car and, together with the traffic police, took the victim to the emergency room.
Emergency situations require speed to ensure human life. During the move, due to urgent requirements, Mr. Vuong ran a red light, which caused the cold fine camera system to record and put the vehicle on the list of violations.
Before the Lunar New Year of At Ty 2025, Mr. Vuong looked up information on traffic fines and discovered that his vehicle was on the list. Immediately after that, Mr. Vuong proactively contacted the Hanoi Traffic Police Department to report the matter.
After receiving the feedback, Hanoi Traffic Police Department verified the entire process and clarified the violation in a special context.
The results determined that Mr. Vuong committed the violation in an urgent situation to save people, which is not subject to punishment under Article 11 of the Law on Handling of Administrative Violations. Therefore, the notice of the fine was removed, ensuring the legitimate rights of citizens.
Rest assured in the fairness of the law
According to the law, administrative violations in urgent situations, to protect human life and health, will not be punished. This not only ensures fairness in the application of the law but also encourages the sense of responsibility of traffic participants, creating a more humane society.
"I feel secure and confident in the provisions of the law. When taking the right action, the government will take appropriate measures to protect the people, not letting anyone suffer when performing noble deeds," Mr. Vuong shared.
Recently, many people have also expressed concern about whether drivers who do not obey traffic lights to give way to priority vehicles or ambulances will be punished?
The Ministry of Public Security confirmed that these cases will not be punished.
According to Article 23 of the 2017 amended Penal Code, the act of running a red light to give way to a priority vehicle on an urgent mission is considered an act in an urgent situation. Therefore, this act is not subject to administrative sanctions or criminal prosecution.
In addition, Article 11 of the Law on Handling of Administrative Violations also clearly stipulates that violations shall not be punished in urgent situations; at the same time, Clause 5, Article 27 of the Law on Road Traffic Order and Safety requires that when there is a signal from a priority vehicle, people and vehicles participating in road traffic must reduce speed, move close to the right side of the road or stop to give way, and toll stations must give priority to priority vehicles in all situations and must not cause obstruction.
"People can rest assured that they will not be wrongly fined by traffic police in these cases," the Ministry of Public Security affirmed.
