The project has many abnormalities in origin
According to Inspection Conclusion No. 01 (February 7.2) of the Cao Bang Provincial Inspectorate, the Dai Loi hill garden coffee shop, restaurant, and motel project (Dai Loi Construction Company Limited - Company) was approved by the Provincial People's Committee for investment in 2019 in Decision No. 1299/QD- UBND dated August 12, 2019.
The total land area of the project approved in Investment Policy Decision No. 1299/QD-UBND dated August 21, 2019 is about 33,594m2, invested in 2 phases with an investment of 38 billion VND.
The issue of origin and transfer of land use management rights in the project is having many unusual problems. The location of the construction site belongs to Group 31 (now Group 19), Song Hien Ward, Cao Bang City.
According to the company's documents, the land for project implementation is currently being managed and used by households that have been granted land use right certificates for different purposes (such as commercial service land, production forest land, remaining rice-growing land).
Currently, the inspection conclusion determines that this project is a candidate for the State to allocate land, lease land, and permit change of land use purpose, not a case of receiving transfer, capital contribution, or lease of agricultural land use rights. At the time of inspection, the company could not provide documents proving that it had been assigned to manage land use and that it did not have land to implement the project.

"Currently, the company does not have any documents showing that the management of land use for the project site has been granted an investment policy, has not set up boundary markings, and has not yet constructed works" - Inspection Conclusion No. 01 stated.
In addition to land scandals, Dai Loi Construction Company Limited also showed weakness in construction aspects. At the end of 2020, the Department of Planning and Investment approved the extension of the project progress in Decision No. 79/QD-SKHDT. Accordingly, the project will be invested in construction within 4 years, and must be completed and put into operation in the fourth quarter of 2024.
After that, the company only carried out a number of procedures such as concept design, architecture... along with the submission to the construction department for appraisal of the construction investment feasibility study report. After that, the Department of Construction responded in writing to this company that the project was not eligible for approval and implementation of the next steps.
According to the actual records of the reporter on February 23 in the project area, there is only one sign "Son River Garden" erected here, the small area of flowered areas is mostly left unused or banana-growing. No construction has been built on the land, except for a few temporary shelters surrounded by cold corrugated iron, 2 hills that have been leveled for a long time, without any appearance of construction machinery or watchmen or security guards.
According to the investigation, the company has paid a deposit of VND 570 million to the Department of Planning and Investment's fund management agency, but due to the project's slow implementation, the enterprise was administratively fined VND 85 million. However, up to now, Dai Loi Construction Company Limited has not paid the fine.
Due to the above-mentioned problems, the Cao Bang Provincial Inspectorate requires Dai Loi Construction Company Limited to terminate the project according to regulations and pay administrative fines. In case the company does not terminate the investment project, the Department of Planning and Investment needs to carry out the procedures to terminate the investment project according to regulations.
The project "Dai Loi Hill Coffee Shop, Restaurant, motel" is one of the projects expected to contribute to the development of tourism in Cao Bang. However, the newly discovered violations have raised many questions. The enterprise has not implemented the project for many years. Resolutely handling violations is necessary to ensure sustainable development of the locality.
