The Ministry of Agriculture and Environment has just issued a document on proposing decentralization and delegation of authority according to the provisions of the Law on Organization of the Government, the Law on Organization of Local Government and the Law on Organization of Local Government at two levels.
Accordingly, the ministry has reviewed and reported to the Prime Minister on the proposed decentralization plan for 129 authorities in the agricultural and environmental fields.
Implementing the direction of the Prime Minister at the Standing Government meeting on the afternoon of May 14, 2025 on decentralization and decentralization associated with the implementation of the two -level local government model, the Ministry of Agriculture and Environment continued to review and report to the Prime Minister on the proposal of decentralization and decentralization for 129 authority in the agricultural and environmental field.
Accordingly, the decentralization and decentralization of the National Assembly's authority to the Government, the Ministry of Agriculture and Environment proposed the decentralization and level of two authority of the National Assembly to the Government (proposed in the draft Law amending and supplementing a number of articles of the Planning Law) including the land field (authority to approve national land use planning); The field of marine and islands (authority approves the national marine spatial planning).
Regarding decentralization and delegation of authority to the Government, the Prime Minister assigned the Minister of Agriculture and Environment, the Ministry of Agriculture and Environment proposed to delegate 39 responsibilities of the Government and the Prime Minister to the Minister of Agriculture and Environment.
Regarding the decentralization and decentralization of the Government, the Prime Minister, the Minister of Agriculture and Environment for the provincial People's Committee and the Ministry of Agriculture, propose 88 authority to the provincial People's Committee. Among them, the two -level authorities of the Government and the Prime Minister to the provincial People's Committee include: Land field 1 authority and environmental environment 1 authority; Decentralized 86 authority of the Minister of Agriculture and Environment to the provincial People's Committee, Chairman of the provincial People's Committee.
Of the 86 authority of the Minister of Agriculture and Environment for the provincial People's Committee, the field of planting and plant protection of 16 authority; Forestry and ranger 5 authority; Seafood 6 authority; irrigation 6 authority; Water resources 9 authority; Environment 6 authority; geology and minerals 12 authority; land 1 authority; Breeding and veterinary 15 authority; Nature preservation and biodiversity 5 authority; Hydrometeorology 1 authority; Quality management of agriculture, forestry and fishery 4 authority.
In the land sector alone, most authority has been delegated and decentralized to local authorities (including: land allocation, land lease, recognition of land use rights, change of land use purpose, land price, compensation for recovery, compensation, support, resettlement, granting land use right certificates, etc.).
Regarding the delimitation of local authorities when not organizing the district -level local government, in addition to proposing decentralization and decentralization for the above 129 authorities, the Ministry of Agriculture and Environment has proposed the decentralization and basic decentralization of the district authorities to the new commune authorities (expected more than 200 tasks) when organizing a two -level local government; Except for 16 authorities proposed to be transferred to the provincial government (mainly transferred to the Department of Agriculture and Environment) due to the scope of implementation in the inter -commune area or guiding and inspecting the commune -level government.
