Living temporarily in his own house
Mr. Pham Ba Loc, whose house is in the project, informed that his family has 2 adjacent level 4 houses, with a total area of 84m2, located in the above-mentioned project planning area. Due to the unfinished construction project, Mr. Loc's family has not received compensation and has not been resettled. He shared: "This house was built by my mother in 1976, and is now seriously degraded. When it rains, it leaks, when the tide rises, it floods everywhere. I asked for repairs but the local authorities did not allow it because the land is in the planning area".
In the same situation, Mr. Le Van Nhut said that his family has a temporary house of 92m2, but because it is located in a suspended planning area, it cannot be traded. He and his wife had to leave their hometown and go to Ho Chi Minh City to work as hired laborers for decades. Recently, when their health was weak, they returned to Bac Lieu and opened a bicycle repair shop right in the temporary house. Mr. Loc said that many houses affected by the suspended planning are now like slums, unrepairable.
30-year project still valid despite being discontinued 17 years ago
Regarding the Trade Center project in Ward 3, Bac Lieu town (the name of the project), on January 11, 1995, Minh Hai Provincial People's Committee (in 1997 split into 2 provinces Bac Lieu and Ca Mau - PV) issued a decision approving the project (DA) to invest in building the Trade Center in Ward 3, invested by Bac Lieu Town People's Committee (now Bac Lieu ward). The total land area for the DA is 40,280m2, with an investment capital of more than 21 billion VND. On May 19, 1995, the Project Management Board of Ward 3 Trade Center, representatives of the investor and Thai Duong Company, the business cooperation party, signed and implemented the DA in the form of a business cooperation contract.
The project was implemented from 1995, but due to many reasons, it was temporarily suspended in 2009. Many construction items are unfinished, and compensation and site clearance work has not been completed. Therefore, 22 households with hundreds of people have been living suspended according to the plan from then until now.
Answering the questions of the households, Mr. Le Viet Xo - Chairman of Bac Lieu Ward, Ca Mau province - said that so far the project has not ended the contract with the previous investor, Thai Duong Company. In the role of investor, the People's Committee of Bac Lieu City (old) has worked many times with Thai Duong Company to negotiate solutions to the problem. The People's Committee of Bac Lieu province (old) has also established a working group to review and inspect to support the implementation process.
Regarding the case of Mr. Pham Ba Loc, he complained from 2008, and in 2011, the People's Committee of Bac Lieu city (old) accepted and resolved it. After many reviews, Bac Lieu province (old), now Ca Mau province, agreed to increase the value of compensation and resettlement support for 22 households, including Mr. Loc's household. However, due to lack of resources (money), the compensation and resettlement plan has not been approved.
Bac Lieu Ward People's Committee affirmed: The project is still continuing to be implemented according to Decision No. 1099/QD-TTg dated December 9, 1998. Therefore, the family's request to be granted a land use right certificate is not in accordance with the law. Regarding the request to temporarily repair the residence because the house has deteriorated, it is also not accepted because Mr. Loc's house is subject to land recovery from 2007.
It is known that the project has been assigned by the Ca Mau Provincial People's Committee to the Provincial Inspectorate to preside over, coordinate with the Ca Mau Department of Agriculture and Environment, Department of Construction and relevant ward and commune People's Committees to study, review, inspect, and advise the Chairman of the Provincial People's Committee to consider and resolve.
