On August 29, Chairman of Hanoi People's Committee Tran Sy Thanh signed and issued Directive No. 12/CT-UBND of the City People's Committee on rectifying the situation of abuse of the requirement to submit certified copies; the requirement to submit documents and papers in cases where information has been integrated on electronic identification cards and electronic identification accounts.
The Directive clearly states that, in addition to the achieved results, in reality, in the city, there is still a situation of abuse of requests for individuals and organizations to submit certified copies; requests to submit documents and papers in cases where information has been integrated on electronic cards and electronic identification accounts that are not necessary, causing inconvenience and cost for people and businesses and waste for society.
In order to rectify the above situation, the Chairman of the City People's Committee requested that agencies in the city's political system as well as related units, socio-political organizations and agencies, units, organizations, and enterprises under Hanoi City, in cases where the law stipulates the submission of a copy, when receiving a copy, the recipient is not required to submit a certified copy, only check and compare the copy with the original and be responsible for the accuracy of the copy compared to the original.
At the same time, priority is given to reuse existing data/documents in the electronic environment, and no documents or papers are required to be submitted in cases where the information has been integrated on an electronic identification card or electronic identification account.
Directors of departments, heads of agencies, departments and branches of the city; Chairmen of People's Committees of communes and wards organize extensive propaganda as prescribed in Clause 1, Article 6 of Decree No. 23/2015/ND-CP and Clause 6, Article 9 of Decree No. 69/2024/ND-CP to all cadres, civil servants, public employees and workers of the agency or unit. In particular, thoroughly grasp, rectify, guide, inspect, and ensure that cadres, civil servants, public employees, and workers of the agency or unit (including units under its management) strictly comply with the above regulations.
Accordingly, cadres, civil servants and public employees are not required to submit certified copies of legal procedures, only required to submit a copy (required to submit the original for comparison if necessary).
Along with that, cadres, civil servants and public employees are not required to have documents and papers if the information in those documents and papers has been integrated on their electronic identification cards and electronic identification accounts in performing administrative procedures and public services (except for cases where specialized laws have other provisions).
Localities and units directing the review of approved internal processes, cutting unnecessary file components, ensuring legal regulations on copies and certified copies. In particular, handling or proposing to strictly handle violations and abuse of certified copies.
The head of the agency or unit is responsible to the Chairman of the City People's Committee for the implementation of this Directive.
The People's Committees of communes and wards, the Chairmen of the People's Committees of communes and wards are responsible to the Chairman of the City People's Committee for ensuring the reception of 100% of the documents for certification of copies from the original as prescribed.
In particular, returning the result is an electronic copy certified from the original to promote reuse in the electronic environment, ensuring the rights and interests of individuals and organizations according to regulations.
