Violation of medical examination regulations
According to the inspection conclusion No. 134-KL-TTR dated October 22, 2024 of the Thanh Hoa Department of Health Inspectorate, through the inspection of a number of medical examination records (GDYK), the inspection agency pointed out that many records were resolved beyond the deadline due to inadequacies in the regulations on the time limit for subjects to undergo re-testing (2nd time). Accordingly, instead of 3 months to determine type 2 diabetes, this unit stipulated that the administrative procedure settlement was only 60 days.
During the appraisal process, officers and employees of Thanh Hoa Medical Appraisal Center directly wrote on the file cover the name of the doctor assigned to handle the case, while this is not allowed.
The doctor who received the file did not submit it to the authorized person to sign the medical examination minutes but assigned the staff of the one-stop department to submit it for signature, stamp the medical examination minutes, then paste the minutes into the file and store them; the professional consultation minutes were not numbered.
According to regulations, the Standing Body of the Council is the Medical Assessment Center, which must organize a professional consultation and make a conclusion before the Medical Assessment Council meeting. However, Thanh Hoa Medical Assessment Center did the opposite. Accordingly, the professional consultation is held by the Medical Assessment Council, not the Center. The Medical Assessment records and the Medical Assessment Council meeting book do not record the presence of the assessment subject at the Council's conclusion meeting.
The summary of the examination results in the file does not record or does not fully record the physical injuries calculated based on the injuries, diseases, and disabilities that serve as the basis for calculating the percentage according to regulations.
The current examination results section in the consultation minutes of some files does not specifically record the medical history and current examination results; there are also files that record the professional consultation results in one way and the Council's conclusion in another.
Some forms requesting specialist examination and the examination results and conclusions of the specialist are printed on the same A4 paper, which is unreasonable and does not show the correct order of implementation because these are two separate steps with two different forms.
Some of the request forms for specialist examination lack the signature of the leader of the Medical Examination Center; the content of the examination and assessment is not clearly stated as in archive file number 370: the section for musculoskeletal specialist examination only states the diagnosis of amputation of half of the left femur.
Investigate one thing, conclude another
The inspection conclusion also pointed out that some records concluded that the rate of body damage was not consistent with the examination results stated in the medical examination records, and the comparison of the rate of damage was not accurate.
Medical examination for disabled subjects, although having similar physical injuries, the conclusions of the medical examination on the level of disability are different.
In some cases, the Council determined that the subject's ability to self-serve was completely blind in both eyes, which was unreasonable because in reality, the person being examined could still see.
Violations at Thanh Hoa Medical Assessment Center did not only occur in 2022 - 2023 as mentioned above, but there were many violations in medical assessment before.
In May 2022, the Inspectorate of the Ministry of Labor, Invalids and Social Affairs inspected 426 appraisal records at the Thanh Hoa Medical Appraisal Center and discovered 18 cases that were not subject to appraisal; 21 cases of war invalids who simultaneously suffered from diseases related to exposure to toxic chemicals but did not summarize the disability rate; 18 cases where the Medical Council concluded that the subject had type 2 diabetes complications but had no legal basis, leading to determining the disability and injury rate higher than the prescribed level.
Thus, the violations of Thanh Hoa Medical Assessment Center lasted for many years, were systematic and involved many different issues.
On November 1, speaking with Lao Dong, the leader of the Thanh Hoa Department of Health said that the department had transferred the case file of violations of Mr. Nguyen Van Tai - Director of the Thanh Hoa Medical Assessment Center, Permanent Vice Chairman of the Medical Assessment Council and of this Center to the Thanh Hoa Provincial Police for investigation and handling according to their authority.
