Lawyer Nguyen Thu Trang, Deputy Director of Heva Law Company Limited, said that the current pension settlement procedures are implemented according to the provisions of the 2024 Law on Social Insurance, effective from July 1, 2025.
Accordingly, the dossier requesting pension benefits for compulsory social insurance participants includes:
Social insurance book.
The original or copy of the document determining the termination of the labor contract or the document terminating the work or the request document of the object specified in points g, h, m and n, clause 1, Article 2 of this Law.
Dossiers requesting pension benefits for people who are preserving compulsory social insurance contributions include:
Social insurance book.
Document of request from the person who is preserving the compulsory social insurance contribution period.
In the case specified in Article 65 of this Law, in addition to the dossier specified in Clause 1 of this Article, there is an additional minutes of the assessment of the level of working capacity reduction of the Medical Assessment Council or a copy of the certificate confirming the level of severe, especially severe disability that may show the conclusion of the Medical Assessment Council clearly stating the percentage of working capacity reduction.
In case specified in point d, clause 1 and point c, clause 2, Article 64 of this Law, in addition to the dossier specified in clause 1 of this Article, there is also a copy of the certificate of HIV infection due to occupational accidents.
Lawyer Nguyen Thu Trang also added that the regulations on resolving pension benefits and one-time social insurance benefits are as follows:
Within 20 days before the time the employee is eligible to receive a pension, the employer submits the dossier specified in Article 77 of this Law to the social insurance agency.
Within 20 days before the time of eligibility for pension, the person who is preserving the compulsory social insurance contribution period shall submit the dossier specified in Article 77 of this Law to the social insurance agency.
When employees are eligible for one-time social insurance benefits, they submit the dossier specified in Article 78 of this Law to the social insurance agency.
Within 20 days, excluding holidays and Tet, from the date of receiving sufficient dossiers as prescribed for people applying for pension benefits or within 07 working days from the date of receiving sufficient dossiers as prescribed for people applying for one-time social insurance benefits, the social insurance agency is responsible for resolving; in case of non-resolution, it must respond in writing and clearly state the reason.
