According to the People's Committee of Kien Giang province, the situation of crimes and law violations related to the organization of rotating savings and credit associations (hereinafter referred to as rotating savings and credit associations) in Kien Giang province has many complicated developments, with many cases of broken rotating savings and credit associations, snatching rotating savings and credit associations with signs of crime, causing huge property damage, seriously affecting the security and order situation in many localities. To proactively prevent, combat and resolve the above situation, the People's Committee of the province issued a Plan to prevent and combat crimes and law violations related to rotating savings and credit associations.
The purpose is to improve the effectiveness of state management of rotating savings and credit associations in the province. Proactively prevent, stop, detect and handle acts of taking advantage of rotating savings and credit associations to lend at high interest rates, defraud and appropriate assets, abuse of trust to appropriate assets, illegal capital mobilization and other violations of the law.
In September 2024, the Investigation Police Agency of Kien Giang Province Police issued a decision to prosecute the case, prosecute the accused, and execute a 4-month temporary detention order against Nguyen Thi Bich Thuy (51 years old), residing in Vinh Thuan District, Kien Giang Province, for the crime of Fraudulent appropriation of property. Thuy arbitrarily used the names of the members to appropriate money, but they did not know and still paid Thuy the full amount as usual. During the period from April 2020 to July 2022, Thuy sold dozens of fake hui shares to many members, appropriating nearly 5 billion VND.
Or in July 2024, the People's Court of Kien Giang province sentenced defendant Nguyen Thi Anh Hong (49 years old, residing in An Bien district, Kien Giang province) to 15 years in prison for fraud and property appropriation. Hong is the female head of a hui with hundreds of members participating.
Hong used many fake members (ghost members) to participate in the hui to collect money, arbitrarily bought and sold the hui to cover up the previous hui chains, leading to the inability to pay. Hong appropriated a total of more than 4.2 billion VND from many hui members to pay debts and for personal expenses. By the end of December 2019, Hong declared the hui bankrupt, with 47 chains still not expired.
The Provincial People's Committee requests to strengthen the propaganda, dissemination and education of the law; knowledge and skills in preventing and combating crimes and violations of the law related to the rotating savings and credit association, especially skills in preventing acts of taking advantage of participating in the rotating savings and credit association to defraud or abuse trust to appropriate property. Conduct investigations and handle crimes and violations of the law related to the rotating savings and credit association, especially acts of taking advantage of the rotating savings and credit association to defraud and appropriate property of rotating savings and credit association members.
The Provincial People's Committee assigned tasks to relevant units to review, deploy, disseminate and organize the implementation of the Plan on preventing and handling fraudulent activities to appropriate assets. Do a good job of grasping the situation, synchronously deploying professional and social prevention measures; promptly detect and prevent crimes and violations of the law related to the hui organization, especially in key and complicated areas.
Recommend, propose, amend, supplement and perfect legal documents on investigation and handling of crimes in the field of rotating savings and credit associations that are still inadequate and not suitable for practice, in order to increase deterrence and education for those who have committed or are intending to commit crimes.
Promptly report to the competent police agency any rotating savings and credit association chains that are likely to be "broken", especially those involving large amounts of assets, causing public outrage.
