Ms. L.T. B. A (HCMC) is a civil servant, who was regularly promoted from specialist rank 6 (3.99) to rank 7 (4.32) on August 1, 2025. However, on August 26, 2025, the decision to increase the regular salary rank was newly issued, and she was retroactively entitled to the salary for August part of the difference in coefficient in September. During the process of arranging the apparatus during the merger, Ms. B.A resigned according to Decree No. 178/2024/ND-CP.
On August 28, 2025, the agency issued a decision on resolving the resignation of civil servants according to Decree No. 178/2024/ND-CP and Decree No. 67/2025/ND-CP, she was allowed to resign voluntarily from August 31, 2025. According to Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP), the current monthly salary is the monthly salary immediately preceding the resignation, including the basic salary according to rank and grade.
Ms. B.A asked, is the current monthly salary to calculate her policies and regimes calculated on a salary coefficient of 3.99 or 4.32?
Regarding this issue, the Ministry of Home Affairs answers as follows:
Based on Conclusion No. 183-KL/TW dated August 1, 2025 of the Politburo and the Secretariat on actively deploying the 2-level local government model, strongly shifting the grassroots level to proactively grasp and manage socio-economics, national defense and security, the Ministry of Home Affairs has issued Document No. 6383/BNV-TCBC dated August 13, 2025 requesting ministries, branches, and localities to urgently resolve policies and regimes before August 31, 2025, the time to quit work to enjoy policies and regimes is no later than September 1, 2025.
Based on the guidance in Document 6383/BNV-TCBC, the competent authority has resolved to dismiss Ms. L.T. B. A from August 31, 2025, the time to calculate policy and regime benefits is calculated from September 1, 2025.
According to the provisions of Clause 6, Article 5 of Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP), the current monthly salary to calculate allowances is the monthly salary immediately preceding the dismissal. Accordingly, the current monthly salary to calculate allowances of Ms. B.A is the salary of August 2025.
