Cancel auction results
On January 7, the leaders of Dien Ban Town People's Committee, Quang Nam Province signed a decision to cancel the results of the auction of mineral exploitation rights for the DB2B mine in Dien Tho Commune, Dien Ban Town.
This is a remedial measure according to the decision of the Inspectorate of the Department of Justice of Quang Nam on administrative sanctions against MT Quang Da Joint Stock Company (461-463 Nguyen Huu Tho, Khue Trung Ward, Cam Le District) for committing the administrative violation of "providing false information and documents to register for auction participation and participate in the auction".
Previously, the Chief Inspector of the Department of Justice of Quang Nam province issued a decision to fine Quang Da MT JSC 17 million VND for the above-mentioned act.
As Lao Dong reported, on October 18, 2024, Hoa Thuan Joint Stock Auction Company organized an auction for the right to exploit sand minerals as common construction materials at the mine marked DB2B, with an area of 6.04 hectares, with an estimated resource of 159,000 cubic meters of sand.
After 20 hours and 200 rounds, MT Quang Da Joint Stock Company was the unit that paid the highest price with the winning bid of more than 370 billion VND, an increase of more than 308 times compared to the starting price (1.2 billion VND).
This is the highest auction price difference ever compared to the starting price, previously recorded in Quang Nam and is considered unrealistic because businesses will find it difficult to make a profit.
Immediately after this unusual auction, Chairman of Quang Nam Provincial People's Committee Le Van Dung requested Dien Ban town, Department of Natural Resources and Environment and Provincial Police to carefully review the auction process and documents related to the DB2B sand mine auction. If there are any violations, they will be strictly handled.
Enterprises falsely declare equity
Through investigation and verification by the Economic Police Department of Quang Nam Provincial Police - it was determined that Quang Da MT JSC submitted a dossier requesting to participate in the auction of mineral exploitation rights for the DB2B sand mine, with the 2023 financial report showing the content of an increase in equity capital of 199 billion VND.
However, this increase in equity capital is incorrect (The 2023 financial report shows the equity capital contribution in cash - in account 111, but in reality the company does not have cash as shown in the financial report).
Thus, MT Quang Da Joint Stock Company violated the prohibition for auction participants as prescribed in Point a, Clause 5, Article 9 of the Law on Property Auction 2016, committing an administrative violation by providing false information and documents to register for auction participation and participate in the auction.
Dien Ban Town People's Committee requests the District Department of Natural Resources and Environment to coordinate with Hoa Thuan Auction Joint Stock Company to handle the deposit (pre-payment) of Quang Da MT JSC paid when participating in the auction of the DB2B mine; urgently advise the Town People's Committee to submit an adjustment to the auction plan for mineral exploitation rights for the DB2B mine to continue the re-auction.
All costs of implementing remedial measures shall be paid by Quang Da Environmental Joint Stock Company.
