On the Ministry of Construction's Information Portal, citizen T.V.D sent a question: "I was granted a certificate of practicing supervision of construction of grade II traffic works according to the provisions of Decree No. 15/2021/ND-CP, valid until March 2028.
According to the provisions of Clause 18, Article 122 of Decree No. 175/2024/ND-CP, how is the content "In case a field is expanded, it is applied according to the provisions of this Decree" understood?
Can the certificate of construction supervision of grade II traffic works be expanded in scope and scope according to the provisions of Appendix VII of Decree No. 175/2024/ND-CP, being allowed to be the head supervisor; supervising the survey and construction of all types of works/elements of works from level II downwards; being allowed to be construction supervisors for all types and levels of works?".
After research, the Department of Economics - Construction Investment Management has the following opinions:
According to the provisions of Clause 18, Article 122 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government:
Organizations and individuals granted capacity certificates and professional certificates according to the provisions of the 2014 Construction Law before the effective date of this Decree are allowed to continue to use certificates according to the field and scope of construction activities recorded on the certificate until the expiration date. In case there are fields that are expanded according to the provisions of this Decree, they are applied according to the provisions of this Decree.
In case citizens have been granted a practicing certificate for Construction Supervision of Transport Works - Grade II, according to the above regulations and the provisions in Section 4.1 Appendix VII of Decree No. 175/2024/ND-CP, citizens "are allowed to be supervisors; supervise the survey and construction of all types of works/elements of works from grade II downwards; are allowed to be construction supervisors of all types and grades of works".
