Mr. T.M.T in Ca Mau reflected that Clause 18, Article 122 of Decree No. 175/2024/ND-CP on construction practice certificates states: "... In cases where a field is expanded according to the provisions of this Decree, it is applied according to the Decree".
Mr. T asked, what are the cases in which the fields mentioned in the above regulations are expanded?
Regarding this issue, the Ministry of Construction has the following opinions:
According to the provisions of Clause 18, Article 122 of Decree No. 175/2024/ND-CP of the Government detailing a number of articles and measures to implement the Construction Law on management of construction activities, then:
Organizations and individuals granted capacity certificates and professional certificates according to the provisions of the 2014 Construction Law before the effective date of this Decree are allowed to continue to use certificates according to the field and scope of construction activities recorded on the certificate until the expiration date. In case there are fields that are expanded according to the provisions of this Decree, they are applied according to the provisions of this Decree".
Therefore, he based on the construction activity area recorded on the issued certificate and the operating area regulations in Appendix VII of Decree No. 175/2024/ND-CP to determine the appropriate operating scope according to the above regulations.
