Voters of Vinh Long proposed that previously, according to Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government detailing a number of contents on construction investment project management, Article 71 stipulates professional experience to be granted a certificate of practice in construction supervision as follows:
"Being a supervisor or construction commander or presiding over the design and construction of the work section under the proposal for a practice certificate for at least 1 project from level I or higher or 2 projects from level II or higher in the field of the proposal for a practice certificate.
Grade II: Having been a supervisor or construction commander or presiding over the design and construction of the work section under the proposal for a practice certificate for at least 1 project from level II or higher or 2 projects from level III or higher in the proposed field for a practice certificate.
Grade III: Having participated in construction supervision or participated in construction design or construction of work subject to the proposal for a practice certificate for at least 01 project from level III or higher or 02 projects from level IV or higher in the field of application for a practice certificate".
Currently, Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Construction Law on construction management. Article 83 of this Decree stipulates professional experience to be granted a certificate of practice in construction supervision as follows:
"Class I: Having been in charge of the professional field of construction supervision of a specialized project management board, a regional project management board or being the head supervisor or presiding over the construction design of the work section under the proposal for a practice certificate for 01 project from level I or higher or 02 project level II.
Grade II: Having been in charge of the professional field of construction supervision of the specialized Project Management Board, the Regional Project Management Board or being the head supervisor or presiding over the construction design of the work section under the proposal for the issuance of a practice certificate for 01 level II project or 02 level III project.
Grade III: Having participated in the professional field of construction supervision of the specialized Project Management Board, the Regional Project Management Board or construction supervision or construction design for work items subject to the proposal for granting a practice certificate for 01 project from level III or higher or 02 project of level IV".
Thus, according to the provisions of Article 83 of Decree No. 175/2024/ND-CP, the professional experience requirement of "construction site commander" and "construction construction" has been removed to be granted a certificate of practice in construction supervision corresponding to the classes.
The above experience has limited the experience of individuals when they wanted to expand their field of activity (from the construction sector to the construction supervision consulting sector).
The glass suggested that the Ministry of Construction consider adjusting and supplementing Article 83 of Decree No. 175/2024/ND-CP in the direction of calculating the professional experience of "only a construction site commander" and "construction supervision" to consider granting a certificate of practice for construction supervision corresponding to the classes.
After studying, the Ministry of Construction responded as follows:
Currently, the National Assembly has passed the Construction Law (amended). In which, the content on the capacity and experience conditions of individuals participating in construction activities is regulated in detail by the Government.
The Ministry of Construction will urgently advise and submit to the Government to issue Decrees guiding the implementation of the Law. The content of the comments of voters in Vinh Long province will be studied and accepted by the Ministry of Construction and included in the amended and supplemented content (if there is sufficient basis) in the Decree replacing Decree No. 175/2024/ND-CP.
