At the 28th session of the Kien Giang Provincial People's Council on November 14, the draft resolution on amending and supplementing the Land Price List for the period 2020 - 2024 of Kien Giang province was approved. Previously, the Land Price List was approved in Resolution No. 290/NQ-HDND dated January 2, 2020 of the Kien Giang Provincial People's Council.
This Resolution stipulates the Land Price List in Kien Giang province, which is applicable until December 31, 2025. The Land Price List for the period 2020 - 2024 in Kien Giang province is used as a basis in the cases specified in Clause 1, Article 109; Clause 1, Article 159 of Land Law No. 31/2024/QH15.
The detailed regulations are divided into a maximum of 3 locations. For projects adjacent to beaches in Phu Quoc City (except Bai Truong), location 1 is calculated from the beach corridor to the 400th meter. Location 2 is calculated from after the 400th meter to the 800th meter. Location 3 is calculated from after the 800th meter to the end of the project planning limit.
Land location limit at Bai Truong, Phu Quoc City has location 1 calculated from the beach corridor to the 350th meter. Location 2 calculated from after the 350th meter to the 700th meter. Location 3 calculated from after the 700th meter to Cua Lap - An Thoi road.
For projects adjacent to roads and beaches, the same applies to the entire province (except for beaches in Phu Quoc). Location 1 is calculated from the road corridor or beach corridor to the 50th meter. Location 2 is calculated from after the 50th meter to the 100th meter. Location 3 is calculated from after the 100th meter to the end of the project planning limit.
For projects adjacent to branch roads of the main road that are not listed in the land price list, determine positions 2 and 3 of the main road. Position 2 is calculated from the road corridor of the branch road connected to the main road listed in the land price list that the land plot or land area is adjacent to up to the 50th meter. Position 3 is calculated from after the 50th meter to the end of the project's planning limit.
In case the land plot or land area is adjusted by different prices (adjacent to both a road and a beach; adjacent to two parallel roads, etc.), the land location limit is determined according to the location with the highest land price. If the location limit is an intersection, the location limit is determined according to the location with the higher land price at that intersection.
The Resolution also approved the content of abolishing industrial park land prices in the Land Price List for the period 2020 - 2024 in Kien Giang province, which was approved in Resolution No. 290/NQ-HDND dated January 2, 2020 of the Provincial People's Council.
For projects that have had land recovery decisions and decisions approving compensation, support and resettlement plans approved before the effective date of this Resolution, the land price for calculating support shall be applied at the time of the decision approving the compensation, support and resettlement plan, not according to this Resolution.
In cases of land allocation, land lease, change of land use purpose, and recognition of land use rights that have been decided by competent authorities before the effective date of this Resolution, the land price shall be applied at the time the decision on land allocation, land lease, change of land use purpose, and recognition of land use rights takes effect, and shall not be subject to this Resolution.
