The Ho Chi Minh City Department of Construction has just sent a document to the People's Committees and the Police of wards, communes, towns, Con Dao special zone and related units on continuing to manage and collect temporary land use fees for part of roads and sidewalks in Ho Chi Minh City.
According to the Department of Construction, the current fee collection is based on Resolution No. 01/2018/NQ-HDND (amended and supplemented by Resolution 07/2020/NQ-HDND), Resolution 15/2023/NQ-HDND (formerly applied in Ho Chi Minh City) and Resolution 106/2019/NQ-HDND (formerly in Ba Ria - Vung Tau province). These resolutions have not yet had documents to be abolished or replaced, so they are still in effect.
Pursuant to the Law on Promulgation of Legal Documents 2025, the above resolutions continue to be applied to the administrative scope of Ho Chi Minh City and the former Ba Ria - Vung Tau province.
Therefore, while waiting for the Ho Chi Minh City People's Committee to decide to assign the management of road infrastructure assets, the Department of Construction requests that specialized units coordinate with the People's Committees at the commune level to receive, guide and transfer the records of organizations and individuals to the Department for settlement according to regulations, and must not be refused.
From January 1, 2024, Ho Chi Minh City officially implemented the collection of temporary fees for sidewalk and road use according to Resolution 15/2023/NQ-HDND.
The fee ranges from 50,000 - 350,000 VND/m2/month for vehicle parking activities; from 20,000 - 100,000 VND/m2/month for other purposes such as business services, trading, organizing cultural events, etc.
After more than a year of implementation, the total revenue from temporary use of sidewalks and roads reached about 7 billion VND.
According to the Ho Chi Minh City Department of Construction, collecting tolls not only helps legalize the use of part of the sidewalk, but also contributes to preserving urban aesthetics.
However, the implementation process is not yet synchronous, many localities have not implemented it seriously, leading to illegal traffic and parking still occurring, causing disorder and raising questions about the transparency of the policy.
To overcome this, the Ho Chi Minh City People's Committee has assigned the Department of Construction to coordinate with the Ho Chi Minh City Institute for Development Studies to develop a Project on management, exploitation and use of roadways and sidewalks according to the Law on Management and Use of Public Assets.
The project will synthesize information and experience from localities that have applied it such as Binh Duong, Ba Ria - Vung Tau before to serve as a basis for implementation throughout Ho Chi Minh City.
If approved, the project will be completed within 12 months, first of all, a pilot program will be organized in some central wards, routes with wide enough sidewalks, suitable for traffic needs, economic development - tourism... then expanded to the entire area.
