The first is to request to receive unemployment benefits according to Form No. 10 issued together with the Decree. This is a document expressing the aspirations of employees to receive unemployment benefits when they meet the conditions according to the provisions of law.
Second is the document confirming the termination of the labor contract, employment contract or termination of employment.
These documents may be labor contracts or work contracts that have expired or completed work under contracts; resignation decisions, dismissal decisions, disciplinary decisions forcing resignation; notices or agreements to terminate labor contracts or work contracts; or confirmation documents of employers, which clearly show employee information, type of contract signed, reasons and time of termination of contract.
For cases where employees work under labor contracts with a term from 1 month to less than 12 months, the document confirming the termination of the contract is the original or certified copy of the signed labor contract.
In special cases, when the labor-using unit no longer has a legal representative or authorized person, employees can request the Department of Home Affairs to carry out confirmation of termination of labor contracts according to the order and procedures specified in the Decree.
The third component of the dossier is the social insurance book.
The social insurance agency is responsible for confirming the unemployment insurance contribution period and returning the social insurance book to employees within the prescribed time limit, as a basis for resolving the unemployment benefit regime.
Regarding the method of submitting dossiers, employees within 3 months from the date of termination of the labor contract, employment contract or termination of employment, if they do not have a job and need to receive unemployment benefits, submit 1 set of dossiers directly at the public employment service organization where the employee needs to receive unemployment benefits or submit them through the National Public Service Portal.
In case workers encounter difficulties due to illness, maternity, accidents, natural disasters, epidemics or other force majeure events, dossiers can be submitted through authorized representatives or sent through postal services as prescribed.
Decree No. 374/2025/ND-CP also clearly stipulates the responsibilities of public employment service organizations in receiving, checking dossiers, scheduling results and submitting them to competent authorities to decide on the enjoyment of unemployment benefits for employees.
In case the dossier is incomplete or information is not clear, employees will be required to supplement and complete it to ensure that the settlement is in accordance with regulations. If employees are not eligible for unemployment benefits, they must respond in writing and state the reasons clearly.
