Sending a question to the Social Insurance agency, reader T.X.M said: "I participated in social insurance until September 2025, which is 1 year and 9 months. Please ask, am I eligible to receive unemployment benefits? What are the benefits enjoyed? Where to submit the application?".
Regarding this issue, Bac Ninh Provincial Social Insurance answers as follows:
Based on Article 38 of the 2025 Employment Law, employees specified in Clause 1, Article 31 of this Law who are paying unemployment insurance are entitled to unemployment benefits when they meet the following conditions:
a) Terminating labor contracts, employment contracts or terminating employment according to the provisions of law that do not fall into one of the cases where the employee unilaterally terminates the labor contract illegally according to the provisions of the Labor Code or the employee retires when they are eligible for a pension.
b) Have paid unemployment insurance for 12 months or more within 24 months before terminating labor contracts, employment contracts or terminating employment according to the provisions of law.
In case employees work under labor contracts with a term from 01 month to less than 12 months, they must pay 12 months or more within 36 months before terminating the labor contract.
c) Have submitted sufficient dossiers to receive unemployment benefits within 03 months from the date of termination of the labor contract, employment contract or termination of employment.
d) Within 10 working days from the date of submitting sufficient dossiers to receive unemployment benefits, if the employee does not belong to one of the cases of having jobs and is subject to compulsory social insurance according to the provisions of the Law on Social Insurance or performs military service, the obligation to participate in the People's Police, the standing militia or goes to study for a period of more than 12 months or complies with the decision to apply measures to be admitted to compulsory education institutions, compulsory drug rehabilitation facilities or temporarily detained, served a prison sentence or emigrated abroad to settle down or die".
Benefit level, benefit period, time of enjoyment and dossiers, order, and procedures for receiving unemployment benefits.
Based on Article 39 of the 2025 Employment Law, the benefit level, benefit period, benefit time and dossiers, procedures for receiving unemployment benefits are as follows:
1. The monthly unemployment benefit level is equal to 60% of the average monthly salary for unemployment insurance contributions of the 06 months of unemployment insurance contributions that have been paid most recently before the termination of the labor contract, employment contract or termination of employment, but not exceeding 05 times the regional minimum monthly salary announced by the Government applied at the last month of unemployment insurance contribution.
2. The time to receive unemployment benefits is calculated according to the number of months of unemployment insurance contribution, for every 12 months to 36 months of contribution, you will receive 03 months of unemployment benefits, then, for every 12 months of additional contribution, you will receive 01 month of unemployment benefits, but the maximum time to receive unemployment benefits is 12 months.
3. The time to receive unemployment benefits is the 11th working day from the date of submitting sufficient applications for unemployment benefits.
4. Employees who are receiving unemployment benefits are entitled to health insurance benefits according to the provisions of the law on health insurance, including the period of temporary suspension of unemployment benefits as prescribed in Clause 2, Article 41 of this Law. Employees who are receiving unemployment benefits are entitled to health insurance contributions from the Social Insurance Fund.
