The People's Committee of Lang Son province has issued Decision No. 66/2025/QD-UBND on amending and supplementing a number of articles of Decision No. 53/2018/QD-UBND and Decision No. 07/2025/QD-UBND related to regulations on the scope of adjacent areas as well as regulations on coordination in handling violations of irrigation works in the province.
According to the new decision, many contents on the protection scope of spillways, reservoir dams and construction items on canals are adjusted more specifically.
Specifically, a spillway under 3m, in the vicinity at least 10m; The spillway is 10m to under 25m high in the vicinity at least 80m, in which the area not violated is 40m downstream and the two shoulders of the dam.
For reservoir dams, clearly define the adjacent areas from the dam body and above, ranging from 10m (level IV dam) to 50m (special level dam).
At the same time, the Provincial People's Committee also added regulations on flood overflow, sewers, bridges, silos, etc. with a minimum protection area of 3m from the construction site outside.
The new decision more clearly assigns the responsibilities of agencies. The Department of Agriculture and Environment shall preside over the work of propaganda, guidance, inspection, and marking of protection boundaries for works.
The People's Committees at the commune and ward levels directly carry out protection, propaganda, and handling of violations within the protection corridor of the project. In case of exceeding the authority, it must be reported to the competent authority for handling.
Organizations and individuals managing irrigation works coordinate with local authorities in reviewing the current status, managing boundaries, and ensuring the safety of works.
In addition, Decision 66/2025 also amends and supplements a number of contents in the Regulations on coordination in handling violations of irrigation works issued with Decision 07/2025/QD-UBND.
In particular, the People's Committees at the commune level are assigned additional authority in inspection, recording, handling and enforcement of violations of the protection corridor of irrigation works. The specialized agencies under the Department will closely coordinate in monitoring, recommending and transferring documents when they exceed their authority.
Decision No. 66/2025/QD-UBND takes effect from September 8, 2025.
