Inspection Conclusion No. 01/KL-TTr of the Cao Bang Provincial Inspectorate, the Dai Loi Garden Coffee Shop, Restaurant, and motel project of Dai Loi Construction Company Limited (Dai Loi Company) was pointed out for many serious violations.
The project was granted an investment policy by the People's Committee of Cao Bang province in 2019 with a total area of 33,594m2, including commercial - service land and part of production forest land, with a total investment of 38 billion VND. However, up to the time of inspection, the company had not yet completed legal procedures related to land use rights, including converting land use purposes, issuing land use right certificates, or signing a legal land lease contract. A part of the land area is still under the management of households that the company has not bought back or leased.
Regarding progress, the project is divided into two phases and is expected to be completed in the fourth quarter of 2024.However, up to now, the project has not been implemented in practice, and no items have been completed.
This delay not only affects local economic development plans but also causes financial losses to investors and stakeholders.
The company also violated financial obligations, had not completed the payment of taxes and fees related to land use rights and did not make a project guarantee deposit as prescribed.
On January 18, 2023, the Chief Inspector of the Department of Planning and Investment of Cao Bang province fined the company VND85 million for not complying with the investment policy decision, but to date the company has not paid the fine. The above violations not only waste land resources but also negatively affect the investment environment and cause loss of state budget revenue.
On February 14, 2023, the People's Committee of Cao Bang province issued document No. 285/TB-UBND, affirming that it would not consider adjusting the project progress due to insufficient legal basis and failure to ensure implementation time.
In this situation, the Provincial Inspectorate requested Dai Loi Construction Company Limited to review, overcome the shortcomings, implement the decision to sanction and terminate the project according to regulations.
According to the actual records of the reporter, in the project area, there is only one sign "Hien River Garden House" erected, the small area of flowered areas is mostly left unused or banana-growing. No construction has been built on the land, except for a few temporary shelters surrounded by cold corrugated iron, 2 hills that have been leveled for a long time, without any appearance of construction machinery or watchmen or security guards.

It is known that Dai Loi Construction Company Limited is located at residential group 6, Bao Lac town, Bao Lac district, Cao Bang province. The legal representative is Mr. Le Van Tuan. This company was first granted business registration on May 12, 2009 with the main occupation of construction of other civil engineering works.
In Khanh Xuan commune, Bao Lac district, this enterprise operates a gas station. However, actual records show that this store has also stopped operating, 3 fuel pumps have also been removed along with some abandoned house works.
Talking to reporters, Mr. Chao Van Toan (Khanh Xuan commune) shared: "Before, I used to go here and fill up gas, but now they suddenly stop selling, which is inconvenient, having to go to town to have a gas station to fill up".
Regarding the activities of Dai Loi Company, a representative of Bao Lac District People's Committee said that although the business address was registered in the area, this enterprise had almost no activities, and there was very little information about the enterprise. "The company owner is not a local, it is possible that they only registered their business address here but did not operate or make any outstanding contributions" - the representative of Bao Lac District People's Committee added.
