Talking on the Government Portal, Mr. Vo Minh Phung in Quang Ngai shared that he is driving a contract car with less than 8 seats on the technology taxi platform (technology car)
According to Clause 9, Article 56, Chapter 4 of Road Law No. 35/2024/QH15, "passenger transport business by taxi is a type of passenger transport business that uses passenger cars with less than 8 seats (excluding the driver's seat) to carry out transportation according to the requirements of passengers; travel expenses are chosen by passengers according to one of the following methods:
The fee is calculated through a counter.
The fee is calculated through a fee-calculating software directly connected to passengers via electronic means.
The fee is according to the agreement with the transport business unit.
Mr. Phung asked, is your vehicle a taxi? because before the above law took effect, his car was given a contract car stamp.
Regarding this issue, the Ministry of Construction responded as follows:
Clause 6, Article 56 of the 2024 Road Law stipulates: "passenger transport business by car includes: passenger transport business by fixed route, public passenger transport business by bus, passenger transport business by taxi, passenger transport business by contract and new types of passenger transport business according to Government regulations".
The Government's Decree No. 158/2024/ND-CP dated stipulates road transport activities.
Article 21 of this Decree stipulates the procedures for granting, re-granting and revoking business licenses for automobiles and four-wheeled motor vehicles.
Article 23 stipulates the management of use, issuance, re-issuance and revocation of badges.
The Ministry of Construction said that according to the above regulations, the choice of business type, business registration, registration to be granted a badge for its own vehicle is based on the needs of the transport business unit self-sealing and registering with the Department of Transport (now the Department of Construction).
Therefore, the registration of the type of transport business and the issuance of the "taxi car" badge or "contract car" badge is the choice of the transport business unit and registered with the Department of Transport (now the Department of Construction).
Therefore, the Ministry of Construction recommends that Mr. Vo Minh Phung choose a suitable type of transportation business and implement it in accordance with the provisions of the 2024 Road Law, Decree No. 158/2024/ND-CP, Circular No. 36/2024/TT-BGTVT.

Therefore, the Ministry recommends that people comply with the provisions of Articles 74, 75 of Decree No. 158/2024/ND-CP and other relevant legal provisions.
