According to the feedback of voters in Lang Son province, currently, people participating in motorbike insurance, when traffic accidents cause property damage or injury, disability to people, property of third parties, according to the agreed liability limit, the settlement of compensation still faces many difficulties, cumbersome procedures and almost no benefits.
Voters propose that competent authorities study reducing procedures when handling insurance claims.
Regarding voters' recommendations, on the Ministry of Finance's electronic information portal, the Ministry said that in October 2024, it sent a document to the National Assembly Delegation of Lang Son province to respond to the payment of motorcycle insurance compensation as follows:
Decree No. 67/2023/ND-CP has inherited and supplemented many new regulations to simplify compensation procedures and ensure the rights of insurance buyers.
The level of compensation for people has been detailed, simple and easy to apply consistently, accordingly the compensation amount is based on the rate of damage determined by the medical facility multiplied by the insurance liability limit (150 million VND).
The compensation file prescribed for the insurance company and the vehicle owner (insurance buyer) includes: Documents that the insurance buyer and the insured are responsible for collecting (Compensation request; Documents related to the motor vehicle, driver; Documents proving damage to health, life, property; Court decision).
The documents that the insurance company is responsible for collecting include: Copies of relevant documents from the police agency in accidents causing death to third parties and passengers or in cases where it is necessary to verify that the accident was caused entirely by the fault of the third party; Minutes of assessment by the insurance company or a person authorized by the insurance company.
The Ministry of Finance affirmed: Decree No. 67/2023/ND-CP guiding insurance compensation procedures has been stipulated simply, ensuring quick and accurate insurance payments, helping accident victims quickly overcome financial difficulties when an unfortunate accident occurs; while ensuring valid records, documents, and certificates for insurance companies to calculate costs.
The Ministry of Finance added that in the coming time, it will strengthen inspection and examination of insurance businesses.
Regarding administrative sanctions, according to the provisions of the Decree on administrative sanctions, insurance companies will be sanctioned if they violate the regulations on insurance compensation and insurance payment.
Recently, the Ministry of Finance has sent many documents to insurance companies to rectify compulsory insurance.
The Ministry noted issues such as maintaining the hotline to promptly receive accident information, provide advice and answers to vehicle owners and insured persons; Checking and reviewing calls to the hotline related to complaints and compensation requests for motorbike owners to have solutions to assign staff to receive and process information about cases where customers request compensation, ensuring proper guidance according to legal regulations, resolving compensation quickly and promptly; Assessing compensation, paying insurance compensation, and making advance insurance compensation quickly and promptly for vehicle owners and insured persons according to regulations; Thoroughly implementing throughout the system to only collect documents from the police in fatal accidents.
The Ministry of Finance will continue to coordinate with relevant agencies to promote and disseminate compulsory civil liability insurance for motor vehicle owners, a type of insurance that actively contributes to social security.
In 2024, the Ministry of Finance will conduct inspections, including inspections of the implementation of compulsory motor vehicle insurance for 4 non-life insurance companies and a thematic inspection of compliance with legal regulations on civil liability insurance for motorbike owners for 8 non-life insurance companies.
Through inspection and examination, if an insurance company is found to be violating regulations, the Ministry of Finance will strictly handle it according to the provisions of law; for difficulties and problems regarding mechanisms and policies in implementing compulsory civil liability insurance for motor vehicle owners (Decree No. 67/2023/ND-CP newly issued), the Ministry of Finance will synthesize and coordinate with agencies to review, study and perfect mechanisms and policies, and report to competent authorities for appropriate adjustments according to regulations.
