The Ministry of Public Security will seek opinions until September 15, 2025 on the draft Circular regulating support expenditures for individuals and organizations providing information reflecting administrative violations of traffic order and safety (drafted for the second time).
Article 8 of this draft Circular stipulates the implementation of support expenditures for individuals and organizations providing information reflecting administrative violations of traffic order and safety as follows:
The Director of the Traffic Police Department decides on spending support for individuals and organizations providing information reflecting administrative violations in cases and matters under his authority to sanction administrative violations and the following positions:
Head of the professional department or equivalent under the Traffic Police Department.
Captain, Squad Leader of the Professional Department or equivalent under the Traffic Police Department.
Officers and soldiers of the Traffic Police Department.
The Head of the Traffic Police Department decides on spending support for individuals and organizations providing information reflecting administrative violations in cases and matters under his/her authority to sanction administrative violations and the following positions:
Chairman of the People's Committee of the province and city.
Director of the Provincial and Municipal Police.
Captain, Station Chief of the Traffic Police Department.
Officers and soldiers of the Traffic Police Department.
The level of expenditure to support individuals and organizations providing information reflecting administrative violations of traffic order and safety shall be implemented according to the provisions of Clause 3, Article 7 of Decree No. 176/2024/ND-CP and the following specific regulations:
For administrative violations that the competent authority has decided to impose a fine of less than VND 30,000,000 for individuals or less than VND 60,000,000 for organizations: The level of expenditure to support individuals and organizations providing information reflecting administrative violations of traffic order and safety in one case or incident is 5% of the amount of administrative violation and a maximum of VND 2,500,000/01 case or incident.
For administrative violations for which the competent authority has decided to impose a fine of VND 30,000,000 or more on individuals or VND 60,000,000 or more on organizations: Level of expenditure to support individuals and organizations providing information reflecting administrative violations of traffic order and safety in one case, the act is 10% of the amount of administrative violation and the maximum is VND 5,000,000 01/case, the act.
The amount of administrative fines used as the basis for determining the level of support for individuals and organizations is the amount of fines for administrative violations that the individual or organization has provided feedback on.
Within 30 days from the date of issuance of the decision on administrative sanctions, the competent person deciding and organizing the implementation of support payments to individuals and organizations has provided feedback.
