The Ministry of Public Security submits a draft Decree amending and supplementing a number of articles of Decree No. 168/2024/ND-CP dated December 26, 2024 of the Government stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring points for driver's licenses.
Stating the reason for amending the Decree in practice, the Ministry of Public Security said that after more than 1 year of implementing Decree No. 168/2024/ND-CP, it has basically met the requirements of strengthening state management efficiency, the results of handling violations have increased, and traffic accidents have decreased significantly compared to the same period.
Accordingly, functional agencies have made records of handling 3,324,346 cases, fined more than 6.727 billion VND, with 634,556 cases of alcohol concentration violations (accounting for 16.65% of violations); 3,401 cases of drivers testing positive for drugs (accounting for 0.09% of violations).
The police have handled 37,931 cases of carrying overloaded goods (accounting for 1% of violations); 786,484 cases of violations of speed regulations (accounting for 20.63% of violations); 57,441 cases of non-compliance with traffic light signals, traffic controller signals (accounting for 1.5% of violations).
178,295 cases of driving in the wrong lane, lane (accounting for 4.68% of violations); 23,639 cases of improper overtaking (accounting for 0.62% of violations).
Drivers engaged in transport business use phones, other electronic devices when driving vehicles and the installation and operation of journey monitoring devices, driver image recording devices 13,865 cases (accounting for 0.36% of violations)...
Handling 147,289 cases of school-age students violating traffic safety and order (accounting for 4.43% of the violations handled).
Also according to information from the drafting agency, during the implementation of Decree 168, there were 18,447 traffic accidents nationwide, killing 10,379 people and injuring 12,282 people (including 26 particularly serious cases, killing 96 people and injuring 74 people).
Compared to the same period in 2024, a decrease of 5,293 cases, a decrease of 708 deaths, and a decrease of 5,257 injuries.
Causes of accidents: due to drivers not paying attention to observation (21.06%), driving in the wrong lane and direction (11.98%); violating traffic safety regulations when changing direction (9.66%); using alcohol and alcoholic beverages (8.2%); overtaking in violation of regulations (3.75%); speeding (3.13%); not giving way (2.9%); not keeping a safe distance (2.81%); crossing the road in violation of regulations (2.14%); violating traffic signs (1.01%); not having a driver's license or a driver's license not issued by a competent authority (0.82%); violating the operating procedures of driving and reversing in violation of regulations (0.58%); avoiding vehicles in violation of regulations (0.52%); fatigue, dozing off (0.44%); stopping and parking in violation of regulations (0.44%); using drugs (0.36%); vehicles not ensuring technical safety (0.09%); other causes (3.37%).
The Ministry of Public Security said that the situation of road traffic order and safety is still complicated. The situation of vehicles not registered for transport business but still carrying passengers and goods to collect money, and transport business vehicles operating "disguised" causes injustice and transparency in transport business activities, and at the same time causes tax revenue loss to the state budget.
This act is also aimed at evading state management of road transport; non-standard container trucks, trucks carrying cargo on trailers, semi-trailers with dimensions exceeding the length and height but without sanctions...
The Ministry of Public Security added that from March 1, 2025, the Ministry of Public Security has taken over the task of state management of management, testing and issuing driver's licenses from the Ministry of Transport (now the Ministry of Construction).
However, in reality, the Traffic Police force has not yet penalized violations related to driving tests because they have not been assigned authority for specific acts of the decree.
The Ministry of Public Security emphasized that, stemming from the above reasons, the study and development of the Decree amending and supplementing a number of articles of Decree No. 168/2024/ND-CP dated December 26, 2024 of the Government stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring driver's license points is extremely necessary.
