The Ministry of Public Security is drafting a Decree amending and supplementing a number of articles of Decree No. 151/2024/ND-CP dated November 15, 2024 of the Government detailing a number of articles and measures to implement the Law on Road Traffic Order and Safety.
This draft Decree is related to compulsory motorbike insurance.
Accordingly, Article 34 stipulates that foreigners driving foreign motor vehicles when participating in traffic in Vietnam are as follows:
Foreigners driving foreign motor vehicles when participating in traffic in Vietnam must follow the group and have a vehicle driver in front to guide them during traffic in Vietnam. The vehicle used for guidance is a car or motorbike suitable for the vehicle used in the group.
Being allowed to participate in traffic on routes, road sections and travel time in Vietnamese territory under the approval document of competent authorities.
When driving foreign motor vehicles participating in traffic, foreigners must comply with the provisions of the law on road traffic order and safety of Vietnam; carry and present when competent authorities request the following documents:
Passport or papers valid for international travel, papers related to residence in Vietnam.
A driver's license suitable for the type of vehicle allowed to be driven, valid within the territory of Vietnam and still valid;
Certificates of technical safety and environmental protection inspection for motor vehicles or equivalent documents issued by the competent authority of the vehicle registration country that are still valid (for cars);
Vehicle registration certificate is issued by the competent authority of the vehicle registration country and is still valid.
Civil liability insurance certificate of motor vehicle owners valid in Vietnam (motorbike insurance, car insurance).
Customs declarations for temporarily imported and re-exported road transport vehicles.
The drafting agency said that this is a regulation inherited from Decree No. 151/2024/ND-CP. In which, it is stipulated that foreigners when driving motorbikes in Vietnam must have compulsory motorbike insurance.
The drafting agency also proposed regulations on the responsibilities of Vietnamese international travel service businesses; organizations and individuals who bring cars with right-hand drives to participate in traffic in Vietnam for non-tourism purposes (Article 35).
Responsibilities of relevant agencies in managing foreigners driving foreign motor vehicles participating in traffic in Vietnam (Article 36).
According to the drafting agency, the above 2 articles have supplemented the responsibilities of Vietnamese international travel service businesses; organizations and individuals bringing cars with right-hand drives to participate in traffic in Vietnam not for tourism purposes.
Regulations include: Arranging tour guides and traffic guidance vehicles with journey monitoring devices and connecting and sharing information with the database of foreign motor vehicles driven by foreigners participating in traffic in Vietnam of the Ministry of Public Security; pasting the name of enterprises or organizations, individuals on the front and rear windshields (for cars), attaching flags with the name of enterprises or organizations, individuals in the front of the vehicle (for motorbikes) for all vehicles in the convoy.
The draft also supplements the responsibility of reporting and monitoring the operation of foreign motor vehicle convoys in real time through the software of the Ministry of Public Security.
Supplementing the responsibility of the Ministry of Finance in connecting and sharing foreign motor vehicle data temporarily imported and re-exported into Vietnam with the Foreign Motor Vehicle Database driven by foreigners participating in traffic in Vietnam of the Ministry of Public Security to ensure consistency with Articles 10, 11, 12 of Decree No. 151/2024/ND-CP.
