The Ministry of Public Security is proposing a draft Decree amending and supplementing a number of articles of Decree No. 151/2024/ND-CP dated November 15, 2024 of the Government detailing a number of articles and measures to implement the Law on Road Traffic Order and Safety.
This draft Decree is related to motorbike insurance. Accordingly, Article 3 of the draft amends and supplements Clause 2, Clause 3 of Article 10 as follows:
The Ministry of Public Security is responsible for building a database on road traffic order and safety and related specialized databases.
Ministries and sectors are responsible for building national databases, specialized databases, connecting and sharing information in accordance with the law with the Road Traffic Order and Safety Database built and managed by the Ministry of Public Security, serving state management of road traffic order and safety and resolving administrative procedures of people and businesses.
Responsibilities for building and managing specialized databases:
The Ministry of Public Security is responsible for building and managing the following database: Database on registration and management of motor vehicles and specialized motorbikes (excluding military vehicles).
Database on handling administrative violations of road traffic order and safety; Database on road traffic accidents; Database on journeys of road vehicles, driver images, passenger compartment images (excluding military vehicles); Database on vehicle control time management of drivers (excluding military vehicles); Database on vehicle registration and specialized motorbikes in the People's Police; Database on driving tests and licenses; Database on certificates of training in road traffic law knowledge in the People's Police; Database on foreign motor vehicles driven by foreigners participating in traffic in Vietnam.
The Ministry of Construction is responsible for building and managing the following databases: Database on vehicle registration, specialized motorbikes (excluding military vehicles, police vehicles); Database on driving training, certificates of training in road traffic legal knowledge for specialized motorbike drivers (excluding data on driving training, certificates of training in legal knowledge of military and police forces).
The Ministry of Finance is responsible for building and managing the following databases: Database on imported and exported vehicles; Database on vehicle purchase and sale invoices; Database on vehicle registration fees; Database on compulsory civil liability insurance of motor vehicle and specialized motor vehicle owners; Database on temporarily imported and re-exported vehicles.
The Ministry of National Defense is responsible for building and managing the database under the management scope of the Ministry of National Defense as follows: Database on registration and inspection of specialized motor vehicles and motorbikes; database on training, testing, issuance of driver's licenses, certificates of fostering legal knowledge on road traffic; Database on road traffic accidents; database on handling administrative violations of road traffic order and safety.
The Ministry of Health is responsible for building and managing the following databases: Database on the health of drivers and specialized motorbike drivers; Database on traffic accident victims.
Explaining this draft, the Ministry of Public Security said that the Decree supplements the database on compulsory civil liability insurance of motor vehicle and specialized motorbike owners and the database on temporarily imported and re-exported vehicles to be consistent with the functions and tasks of the Ministry of Finance.
The Decree also clearly assigns the responsibility of the Ministry of Public Security in building a database on road traffic order and safety and related specialized databases to resolve administrative procedures of people and businesses.
Supplementing the responsibility of the Ministry of Public Security in building and managing a database on passenger compartment images and a database on foreign motor vehicles driven by foreigners participating in traffic in Vietnam to ensure compliance with the Law on Road Traffic Order and Safety amended and supplemented by the Law amending and supplementing a number of articles of 10 laws related to security, order and serving state management of foreign motor vehicles driven by foreigners participating in traffic in Vietnam.
Amending the name of the database on driving training, certificates of training in legal knowledge on road traffic for specialized motorbike drivers to be consistent with the amended Law on Road Traffic Order and Safety.
Abolishing the database on drivers of motor vehicles and specialized motorbikes to comply with the amended Law on Road Traffic Order and Safety.
Supplementing the database of traffic accident victims to serve state management work.
