Regarding this issue, the Ministry of Finance is proposing a draft Decree amending and supplementing a number of articles of Decree No. 67/2023/ND-CP stipulating compulsory civil liability insurance for motor vehicle owners, compulsory fire and explosion insurance, and compulsory insurance in construction investment activities. This Decree is expected to take effect from July 1, 2026.
Analyzing the new points of the draft decree, Lawyer Nguyen Thu Trang, Deputy Director of HeVa Law Company Limited, said that the draft Decree amending and supplementing a number of articles of Decree No. 67/2023/ND-CP mainly amends regulations on construction activity insurance. The new draft continues to inherit regulations on compulsory motorbike insurance (civil liability insurance for motor vehicles).
Accordingly, people need to note that motorbike insurance continues to be a mandatory type of insurance.
Some other regulations on motorbike insurance that people need to pay attention to. The Law on Road Traffic Order and Safety stipulates the conditions for vehicle drivers participating in road traffic.
Accordingly, drivers participating in road traffic must be of sufficient age and health according to the provisions of law; have a driver's license that is still valid and valid, suitable for the type of vehicle they are driving, issued by a competent authority, except for motorbike drivers specified in Clause 4 of this Article. When participating in road traffic, drivers must bring the following documents:
Vehicle registration certificate or certified copy of Vehicle Registration Certificate with original confirmation documents of credit institutions, foreign bank branches still valid in cases where the vehicle is being mortgaged at credit institutions, foreign bank branches.
A driver's license suitable for the type of vehicle being driven.
Certificate of technical safety and environmental protection inspection for motor vehicles according to the provisions of law.
Certificate of compulsory civil liability insurance of motor vehicle owners.
If you do not bring compulsory motorbike insurance, vehicle drivers may be penalized according to Decree 168/2024/ND-CP.
Accordingly, functional agencies shall fine from 200,000 VND to 300,000 VND for one of the following violations:
Drivers of motorbikes, mopeds, similar types of motorbikes and similar types of mopeds engaged in transportation business who do not carry the valid compulsory civil liability insurance certificate of the motor vehicle owner.
Drivers of motorbikes, mopeds, similar types of motorbikes and similar types of mopeds who do not have a valid compulsory civil liability insurance certificate of the motor vehicle owner.
