Many people think that administrative violations of traffic safety in cars are always punished more severely than those in motorbikes. However, according to the provisions of Decree 168/2024/ND-CP (Decree 168) effective from January 1, 2025, there are violations in motorbikes that have higher penalties than those in cars.
According to lawyer Dang Thanh Tri (Dang Thanh Law Firm, Ba Ria - Vung Tau Province Bar Association), the act of continuously revving the engine on a motorbike is currently subject to a penalty 10 times higher than that of a car according to Decree 168.
At point b, clause 3, article 6 of Decree 168, the act of a car driver "using the horn, revving the engine continuously..." will be fined from 800,000 VND to 1 million VND; points will not be deducted or the driver's license revoked.
At point k, clause 9, article 7 of Decree 168, the act of a motorcyclist "using the horn, revving the engine (exhaust) continuously in a densely populated area..." will be fined from 8 million to 10 million VND. At the same time, the driver's license will be revoked for 10-12 months according to the provisions at point b, clause 12, article 7.
"Thus, the penalty for revving a motorbike is 10 times higher than the same penalty for a car, not including additional penalties," said lawyer Tri.
In addition, the act of continuously revving the engine of a motorbike or scooter, if causing a traffic accident, will be subject to a fine of 10-14 million VND (stipulated in Point b, Clause 10, Article 7 of Decree 168); the same act on a car, if causing a traffic accident, will be subject to a fine of 20-22 million VND (stipulated in Point b, Clause 10, Article 6 of Decree 168).
According to the Traffic Police - Public Order Team of Vung Tau City Police, from January 1, 2025 to present, the unit has issued fines for 547 violations, with a total fine of more than 1 billion VND.
Since the application of the new penalty level according to Decree 168, the situation of traffic safety violations in the area has clearly changed in a positive direction. In particular, traffic accidents have decreased sharply in all 3 criteria; there have been no cases of causing traffic disorder, revving the exhaust pipe, changing the vehicle structure, etc.
