The Vietnam Register recommends that from January 2, 2025, when inspection facilities resume operations after the New Year holiday and Decree No. 166/2024/ND-CP of the Government takes effect from January 1, 2025, regulating the conditions for business of motor vehicle inspection services; organization and operation of inspection facilities; and the life span of motor vehicles takes effect, there will be many cases where vehicles are refused inspection.
"The reason is that for a long time, vehicle owners and inspection facilities have not followed regulations on motor vehicle inspection activities," the Vietnam Register warned.
Cases of refusal to register from January 1, 2025 are as follows:
Administrative violations in the field of road traffic order and safety.
At the request of the prosecuting authorities.
There is evidence of the vehicle owner falsifying vehicle documents.
There is a discrepancy between the vehicle registration certificate and the actual vehicle during inspection procedures.
Not yet performing the vehicle registration certificate renewal at the next inspection after the vehicle has been granted a renovation certificate.
According to the Department of Registration, with the above regulations, a series of vehicles will be refused inspection, for the following reasons:
The vehicle owner has not yet fulfilled his responsibility to resolve administrative violations in the field of road traffic order and safety.
The vehicle has been renovated but the owner has not completed the procedure to change the Vehicle Registration Certificate.
The vehicle has been converted to a transport business (yellow license plate) but the owner has not completed the procedure to change the Vehicle Registration Certificate or vice versa.
The paint color on the vehicle registration certificate does not match the actual vehicle color.
The vehicle owner arbitrarily changes or modifies the vehicle, resulting in the vehicle's technical specifications being different from the vehicle registration certificate.
According to the Vietnam Register, this regulation is issued so that vehicle registration facilities and vehicle owners must comply with it, ensuring the rule of law and unifying vehicle data between vehicle registration agencies and vehicle registration agencies, creating favorable conditions for vehicle management and handling of violations.
Along with that, to remove difficulties, resolve existing problems, obstacles, and shortcomings in the past and create favorable conditions for people and businesses to be able to carry out procedures to re-issue vehicle registration certificates, Circular No. 47 has stipulated that the certification of modified vehicles and re-issuance of modified vehicle certificates are carried out at all motor vehicle inspection facilities nationwide, in which it clearly stipulates a number of cases:
The Vietnam Register instructs that motor vehicles with information that is different from the vehicle registration certificate, but have not been granted a certificate of renovation, must carry out the procedures for certification of renovation according to the following regulations.
In case the motor vehicle has discrepancies with the vehicle registration certificate, the technical specifications and images of the vehicle are consistent with the inspection certificate issued at the most recent inspection before the effective date of Circular No. 47, the issuance of the certificate for the modified vehicle shall be carried out as if the vehicle is exempt from design documents (Regulations at Point i, Clause 5, Article 20 of Circular No. 47).
In case the motor vehicle has discrepancies with the vehicle registration certificate, the technical parameters: Vehicle weight; structure, cargo size; vehicle overall size are discrepancies with the inspection certificate issued most recently before the effective date of Circular No. 47, the procedure for certifying the modified motor vehicle must be carried out. The vehicle owner must prepare a design file for inspection, assessment and issuance of a modified certificate (Regulations in Clause 3, Article 21 of Circular No. 47).
In cases where a vehicle has been modified but has not yet undergone the procedure to change the vehicle registration certificate, and the modified vehicle certificate is lost or expired or incorrectly issued, the vehicle owner will be reissued a modified vehicle certificate to carry out the reissuance of the vehicle registration certificate (Article 24 of Circular No. 47), in which the vehicle owner needs to pay attention to the case.
Motor vehicles that have been granted a certificate of renovation but have expired according to the provisions of law at the time of granting the certificate of renovation, the vehicle owner has a need to re-issue the certificate of vehicle registration to be re-issued based on the results of the comparison between the actual vehicle and the technical specifications of the granted certificate of renovation (stipulated in Clause 5, Article 24 of Circular No. 47). If it is suitable, the certificate of renovation of the motor vehicle will be re-issued to the vehicle owner. If it is not suitable, the vehicle owner must comply with the provisions of Article 20, Article 21, Article 23 of Circular No. 47 to be granted a certificate of renovation of the vehicle.
In other cases where vehicle inspection is refused, the vehicle owner must proactively contact the competent authorities such as: Vehicle registration agency, agency handling administrative violations in the field of road traffic order and safety, and prosecution agency (Police, Procuracy, Court) for resolution.
