Decree 168/2024/ND-CP on penalties and deduction of driving license points for motorcyclists who violate regulations on vehicle conditions when participating in traffic takes effect from January 1, 2025 (Decree 168/2024/ND-CP).
Point a, Clause 4, Article 40 stipulates as follows: A fine of 16 million to 20 million VND shall be imposed on a vehicle inspection facility that commits one of the following violations:
Inspection, issuance of inspection certificates for motor vehicles, specialized motorbikes, and inspection of motorbike emissions that do not comply with regulations, standards, and technical regulations.
In addition, Article 40 of Decree 168/2024/ND-CP stipulates penalties for violations of regulations on inspection of motor vehicles, specialized motorbikes, and motor vehicle spare parts as follows:
A fine of VND 8,000,000 to VND 10,000,000 shall be imposed on an individual who commits one of the following violations:
Failure to comply with regulations in relevant technical procedures and standards in certification and inspection of motor vehicles, specialized motorbikes, and motor vehicle spare parts.
Failure to properly perform assigned duties and responsibilities in certifying and inspecting motor vehicles, specialized motorbikes, and motor vehicle spare parts.
Making requests that are contrary to regulations on inspection procedures and processes for individuals and organizations.
A fine of VND 10,000,000 to VND 15,000,000 shall be imposed on a vehicle inspection facility that commits one of the following violations:
Failure to maintain the assurance of conditions and requirements as prescribed in the Government's Decree regulating the conditions for business of motor vehicle inspection services; organization and operation of inspection facilities; and the life span of motor vehicles.
There are 02 or more inspectors who are punished according to the provisions of Clause 1 of this Article within 12 months from the first violation.
Assigning unqualified people to perform the duties of inspectors and professional staff.
Issuing certificates of renovation for motor vehicles and specialized motorbikes that are not in accordance with regulations.
Conduct inspection for vehicles that are refused inspection according to regulations.
Storing records, documents, vehicle inspection and modification data in violation of regulations.
Failure to update vehicle records for motor vehicles and specialized motorbikes as prescribed.
A fine of 10 million to 15 million VND shall be imposed on a facility testing and certifying motor vehicles, specialized motorbikes, and motor vehicle spare parts in production, assembly, and import that commits one of the following violations:
Failure to publicly post testing and certification procedures and processes as prescribed.
Conduct testing and certification in violation of regulations.
Assign unqualified people to perform testing and certification.
Using equipment and tools that do not meet the regulations of the law on measurement for inspection and testing.
There are 02 or more inspectors who are punished according to regulations within 12 months from the first punishment.
Storing records, documents, and certified data in violation of regulations.
A fine of VND 16,000,000 to VND 20,000,000 shall be imposed on a vehicle inspection facility that commits one of the following violations:
Making requests that are contrary to regulations on inspection procedures and processes for individuals and organizations.
Refuse to provide inspection services that do not comply with the law.
A fine of VND 16,000,000 to VND 20,000,000 shall be imposed on a manufacturing, assembling, importing, warranty and maintenance facility or an authorized organization or individual that commits one of the following violations:
Using or providing fake records and documents to conduct inspection, certification, or testing but not to the extent of being subject to criminal prosecution.
Using equipment and tools that do not meet the regulations of the law on measurement to check the factory quality of motor vehicles, specialized motorbikes, and motor vehicle spare parts.
