Circular 13/2025/TT-BCA regulating the amendment of Circulars on road, railway and inland waterway traffic order and safety (Circular 13,). The Circular takes effect from March 1, 2025.
Article 11 of Circular 13 amends and supplements a number of regulations on patrol, control, and handling of violations of the law on road traffic order and safety by traffic police. Some points to note are as follows:
In case the vehicle owner, organization or individual involved in the administrative violation does not reside or have headquarters in the district where the administrative violation is detected, the collected results shall be transferred to the commune-level police where the vehicle owner, organization or individual involved in the administrative violation resides or has headquarters.
In case of administrative violations under the authority of the commune-level police chief but the commune-level police have not been equipped with a connected network system, the collection results will be transferred to the traffic police department where the vehicle owner, organization or individual resides, and the headquarters is located to resolve and handle the violation.
Sending a notice requesting vehicle owners, organizations and individuals involved in the administrative violation to go to the headquarters of the police agency where the administrative violation was detected or to the headquarters of the traffic police teams and stations under the traffic police department, the commune-level police where they reside, and to close the headquarters to resolve the administrative violation if travel is difficult and there are no conditions to go directly to the headquarters of the police agency where the administrative violation was detected according to regulations.
The sending of violation notices is done in writing, by electromagnetic connection, sharing data on the VNeTraffic App when meeting the conditions of infrastructure, technology, and information.
At the same time, update information of the violating vehicle (vehicle type; license plate, license plate color; time, location of violation, violation behavior; unit detecting the violation; unit handling the case, contact phone number) on the Traffic Police Department's website, VNeTraffic App so that vehicle owners, organizations, and individuals related to administrative violations know, look up, and contact to resolve.
