Circular 13/2025/TT-BCA regulates the amendment of Circulars on road, railway and inland waterway traffic order and safety. The Circular takes effect from March 1, 2025.
The above Circular has regulations related to commune police as follows:
In cases where there is no traffic police force accompanying, the commune police can only inspect and handle violations on routes under their management according to the plan issued by competent authorities and report the implementation results to the traffic police force.
In case the driver of a motorbike, motorbike, or rudimentary vehicle is found to have one of the following violations of the law, he/she shall be handled according to regulations: not wearing a helmet according to regulations; carrying more people than the prescribed number; carrying bulky goods, exceeding the prescribed size limit; stopping or parking the vehicle in violation of regulations; weaving, swerving, driving the vehicle on one wheel for a two-wheeled vehicle; not having a rearview mirror on the left side as prescribed; using an umbrella; pulling or pushing other vehicles or objects; not old enough to drive a vehicle according to regulations or detecting serious violations of road traffic order, safety, security, and social order.
When resolving and handling the violation, if other violations are discovered, they will be handled according to their authority. If it exceeds the sanctioning authority, a record of administrative violations will be drawn up and reported to the competent authority for handling according to regulations.
The process of stopping vehicles, checking, and handling violations shall comply with the provisions of this Circular.
Thus, compared to Circular No. 73/2024/TT-BCA, from March 1, the regulations on patrolling and controlling commune police have some changes.
Before the amendment, the scope of operation of the commune police was only allowed to patrol, control, and handle violations on commune and village roads under their management.
From March 1, the commune police will be allowed to inspect and handle violations on routes under their management according to the plan approved by competent authorities.
Thus, the patrol and control scope of the commune police is more widespread than before, no longer limited to commune and village roads but to roads under management.
Regarding regulations on handling violations, from March 1, commune police will be allowed to immediately handle violations without conditions, if not prevented promptly, it will cause dangerous consequences.
