Decree 168/2024/ND-CP on penalties and deduction of driving license points for violations of regulations on conditions for motor vehicle drivers takes effect from January 1, 2025 (Decree 168).
Clause 9, Article 7 of Decree 168 stipulates a fine of VND 8,000,000 to VND 10,000,000 for motorcyclists who commit one of the following violations:
Driving a vehicle in a zigzag or swerving manner on the road; using the kickstand or other objects to scrape the road while the vehicle is running;
Driving in groups of 2 or more vehicles at a speed exceeding the prescribed speed limit.
Causing a traffic accident by not stopping the vehicle immediately, not preserving the scene, not assisting the victim, not staying at the scene or not immediately reporting to the nearest police station or People's Committee.
Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath.
Failure to comply with the request for alcohol testing by an officer on duty.
Driving on the road while having drugs or other stimulants in the body that are prohibited by law;
Failure to comply with the request of a person on official duty to test for drugs or other stimulants prohibited by law.
Sit in the back and put your arms around the person in front to control the vehicle, except when carrying a child under 6 years old sitting in the front.
Driving in groups that obstruct traffic, except in cases where permission is granted by a competent authority.
Using horns and revving engines continuously in densely populated areas or medical facilities, except for priority vehicles on duty as prescribed.
Thus, according to new regulations from today (January 1), the highest fine for motorcyclists violating alcohol concentration is up to 10 million VND.
People should note that the fine for motorcyclists violating alcohol concentration will change from January 1, 2025 as follows:
Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath will be fined from 2 million VND - 3 million VND as in Decree 100/2019. However, there is a change that the driver will have 4 points deducted from the driver's license instead of having the license revoked immediately at the time of violation.
Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath has a new fine of 6 million VND - 8 million VND (an increase of 2 million VND compared to Decree 100). In addition, the driver will have 10 points deducted from his/her driving license (instead of having his/her license revoked for 16 - 18 months as in Decree 100).
Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath, the violator will be fined from 8 million VND to 10 million VND (an increase of 2 million VND compared to Decree 100/2019) and have their driving license revoked for 22-24 months.
