Violations still exist

Talking to Lao Dong Newspaper reporters about this issue, Xuan Phuong Ward People's Committee said it is handling two construction works violating construction order at addresses 18-BT10 and 09-BT11.
Mr. Tran Van Hoan - Vice Chairman of Xuan Phuong Ward People's Committee - was assigned to preside over the assignment of forces to inspect and supervise the self-remediation and dismantling of the construction violating construction order at house number 18-BT10. Weekly, report to the Chairman of the Ward People's Committee on the implementation of documents of competent authorities, coordination between forces and results of self-remediation.
Xuan Phuong Ward Police were also assigned to develop a duty schedule and assign forces to be on duty at construction sites where violations occurred. Members on duty are responsible for strictly controlling people entering and leaving the construction site, and keeping a daily diary to record the process of self-remediation and dismantling of construction sites that violate construction order.
Mr. Nguyen Tai Dung - Chairman of Xuan Phuong Ward People's Committee assigned the Head of Residential Group No. 6 and the Head of the Security and Order Team to coordinate with the ward's forces to supervise the self-remediation and dismantling of the violating construction part; strengthen control of the area, detect cases with risks of violating construction order, promptly report to the leaders of the ward People's Committee for direction and handling according to regulations.
Despite the above instructions, according to PV's records, by the end of December 2024, violations at projects 18-BT10, 09-BT11 and some other projects have not been thoroughly handled.
Talking to Lao Dong Newspaper, Mr. Nguyen The Diep - Member of Vietnam Real Estate Association, Vice President of Hanoi Real Estate Club - expressed his opinion: "If it is called an urban area, it must comply with clear regulations, typically regulations on construction density, height, number of floors, and house design models. It is impossible to build haphazardly in an urban area. The situation of allowing construction of different heights and different construction densities compared to the planning, clearly here the local authorities are responsible."
Mr. Diep said that forces such as local land authorities and construction inspectors do not have appropriate sanctions, so violations are still allowed to go unpunished.
"It is necessary to complete sanctions to handle management agencies if they do not fulfill their responsibilities, allowing such phenomena to occur in the area," said Mr. Diep.
Regarding the case of Xuan Phuong Urban Area reported by Lao Dong Newspaper, Mr. Nguyen The Diep reaffirmed his viewpoint that in urban areas "there is a plan that must be followed and consistent", at the same time, it is necessary to further enhance the responsibility of monitoring and handling violations of local authorities at all levels.
Decisive measures are needed.
In fact, Xuan Phuong Ecological Urban Area (Foresa Villa) is just one of many urban areas in Hanoi that have violated construction order and planning.
According to statistics from the Hanoi Department of Construction, in the first 6 months of 2024, the People's Committees of districts, towns and cities issued 313 decisions on administrative sanctions for violations in construction activities, with a total amount of nearly 6.6 billion VND, collecting nearly 5 billion VND for the state budget.
However, violations still occur. The reason for this situation is explained as subjects often take advantage of holidays to commit violations of construction order or the thin staff force leads to difficulties in management.
The urban construction order management force, when discussing, also said that they encountered difficulties in managing construction order when investors took advantage of days off, holidays or working at night to deliberately violate, causing difficulties for inspection work. Preventive measures applied to the field of construction order have not been effective.
To prevent violations of construction order in Hanoi, the newly approved Capital Law (amended) by the National Assembly stipulates (Clause 2, Article 33): "In cases where it is absolutely necessary to ensure security, order and social safety in the city, the Chairman of the People's Committee at all levels may apply measures to request the suspension of electricity and water supply to construction works, production and business establishments".
Currently, Hanoi City is seeking opinions on a draft resolution of the Hanoi People's Council, specifying this regulation. The resolution stipulates a number of cases where measures are applied to request the suspension of electricity and water services.
