From January 1, 2025, the fine for alcohol concentration violations for drivers of cars, motorbikes, specialized motorbikes, and bicycles will change.

Decree No. 168/2024/ND-CP, regulating administrative sanctions for violations in the field of road traffic, deduction of points, and restoration of driving license points, will officially take effect from January 1, 2025. This Decree will replace Decree 100/2019/ND-CP (amended and supplemented by Decree 123/ND-CP).

Decree 168 has many notable adjustments in terms of fines. Some violations and groups of violations have increased fines many times higher than the current level.

Regarding alcohol concentration violations, the regulations in Decree 168 also have changes in the penalty level compared to Decree 100/2019.

Accordingly, for cars, as follows:

Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath will be fined from 6 million VND - 8 million VND as in Decree 100/2019. However, there is a change that the driver will have 4 points deducted from the driver's license instead of having the license revoked immediately at the time of violation.

Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath will have a new fine of 18 million VND - 20 million VND (an increase of 2 million VND compared to the current one). In addition, the driver will have 10 points deducted from his/her driving license (instead of having his/her license revoked for 16 - 18 months as per Decree 100).

Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath, the violator will be fined from 30 million VND - 40 million VND and have his/her driving license revoked for 22 - 24 months (as per Decree 100/2019).

For motorcycles, as follows:

Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath will be fined from 2 million VND - 3 million VND as in Decree 100/2019. However, there is a change that the driver will have 4 points deducted from the driver's license instead of having the license revoked immediately at the time of violation.

Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath will have a new fine of 6 million VND - 8 million VND (an increase of 2 million VND compared to the current one). In addition, the driver will have 10 points deducted from his/her driving license (instead of having his/her license revoked for 16 - 18 months as per Decree 100).

Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath, the violator will be fined from 8 million VND to 10 million VND (an increase of 2 million VND compared to Decree 100/2019) and have their driving license revoked for 22-24 months.

For bicycles, motorbikes, as follows:

Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath will be fined from 100,000 VND - 200,000 VND (current fine is 80,000 VND - 100,000 VND).

Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath has a new fine of 300,000 VND - 400,000 VND (current fine is 200,000 VND - 300,000 VND).

Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath, the violator will be fined 400,000 VND - 600,000 VND (equal to the current fine).

For specialized motorcycles, as follows:

Not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath will be fined from 3 million VND - 5 million VND as in Decree 100/2019. The right to use the certificate of training in road traffic law knowledge will be revoked for 10 - 12 months.

Exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath will be fined from 6 million VND to 8 million VND (as per Decree 100/2019). The right to use the certificate of training in road traffic law will be revoked for 16 - 18 months.

Exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath, the violator will be fined from 18 million VND to 20 million VND (an increase of 2 million VND compared to Decree 100/2019) and have the right to use the certificate of training in road traffic law revoked for 22 - 24 months.

Article 58 of the 2024 Law on Road Traffic Order and Safety clearly states that driving license points are used to manage drivers' compliance with laws on road traffic order and safety on the road traffic order and safety database system, including 12 points.

In cases where all points in the driving license are deducted, after a period of at least 6 months from the date of deduction of all points, the person with a driving license is allowed to participate in the test on legal knowledge on road traffic order and safety as prescribed in Clause 7, Article 61 of this Law organized by the Traffic Police force, and if the result is satisfactory, the full 12 points will be restored.
