Recently, the Traffic Police Department of Khanh Hoa Provincial Police has continuously received reports from people about cars encroaching on motorbike and rudimentary vehicles lanes on the coastal routes of Tran Phu and Pham Van Dong (Nha Trang Ward).
Some cases are still right, causing frustration and posing a potential risk of traffic accidents.
According to the Traffic Police Department, Tran Phu and Pham Van Dong streets both have a median strip, organized in 2 separate directions, each direction includes 2 lanes. The maximum speed allowed for motor vehicles (cars, motorbikes over 50cm3 and electric motorbikes over 4kW) is 60km/h, unless there is a sign regulating the lower speed.
The rules for using lanes stipulate: slow-moving vehicles must keep the right side in the direction of movement; when changing lanes, must turn on the signal and ensure safety; rudimentary vehicles must move in the inner right lane, while motor vehicles and specialized motorbikes must move in the left lane; must not enter the lane reserved for other types of vehicles.
The law also stipulates that overtaking must be done on the left side. Only in some special cases can the right side be overtaken, such as: The vehicle in front has a signal to turn left, is turning left, or the specialized vehicle under construction cannot overtaken the left side.
According to the Traffic Police Department, the Tran Phu and Pham Van Dong routes are only arranged with one lane for cars. Therefore, the vehicle behind can only overtake the right when the vehicle in front signals to turn left or has a legitimate reason according to regulations. Drivers are absolutely not allowed to encroach on the motorcycle lane to overtake.
According to Decree 168/2024/ND-CP on administrative sanctions for violations in the field of road traffic:
Fault in driving in the wrong lane: Fine 4 - 6 million VND, deduct 2 driving license points. Fault to exceed when not allowed: Fine 4 - 6 million VND, deducted 2 points from the driver's license.
Thus, a driver who encroaches on a motorbike lane to overtake can be fined up to 10 million VND and have 4 points deducted from his/her driving license.
In case the act leads to a traffic accident, the car driver will be fined from 20 to 22 million VND and have 10 points deducted from the driver's license.
