Article 43 of Decree No. 168/2024/ND-CP (penalties and deduction of driving license points for violations of regulations on conditions for motor vehicle drivers) effective from January 1, 2025 is as follows:
Penalty authority of the People's Police
People's Public Security officers on duty have the right to:
Warning;
Fine up to 500,000 VND.
The head of the company-level Mobile Police unit, the station chief, and the team leader of the person specified in Clause 1 of this Article have the right to:
Warning penalty.
Fine up to 1,500,000 VND.
The Chief of Commune-level Police, Chief of Police Station, Chief of Border Gate Police Station, Export Processing Zone Police Station, and Battalion Commander of Mobile Police Battalion have the right to:
Warning penalty.
Fine up to 2,500,000 VND.
Confiscation of exhibits and means used to commit administrative violations with a value not exceeding VND 5,000,000.
Apply the prescribed remedial measures.
District-level Police Chief; Head of the professional department of the Traffic Police Department; Head of the professional department of the Department of Administrative Management of Social Order Police; Head of the provincial-level Police Department including: Head of the Department of Administrative Management of Social Order Police, Head of the Traffic Police Department, Head of the Mobile Police Department, Commander of the Mobile Police Regiment have the right to:
Warning penalty.
Fine up to 15,000,000 VND.
Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.
Confiscation of exhibits and means used to commit administrative violations with a value not exceeding 30,000,000 VND.
Apply the prescribed remedial measures.
Provincial Police Director has the right to:
Warning penalty.
Fine up to 37,500,000 VND.
Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.
Confiscation of exhibits and means used to commit administrative violations.
Apply the prescribed remedial measures.
The Director of the Traffic Police Department, the Director of the Administrative Police Department for Social Order, and the Commander of the Mobile Police have the right to:
Warning penalty.
Fine up to 75,000,000 VND.
Revoke the right to use a license or practice certificate for a limited period of time or suspend operations for a limited period of time.
Confiscation of exhibits and means used to commit administrative violations.
Apply the prescribed remedial measures.
