Responsibility of commune police in recovering vehicle license plates

According to regulations from 2025, commune police will have some responsibilities in recovering vehicle license plates.

Article 27 of Circular 79/2024/TT-BCA stipulates the issuance and revocation of vehicle registration certificates and license plates of motor vehicles and specialized motorbikes (effective from 2025) on the responsibilities of police units and localities in revoking vehicle registration certificates and license plates as follows:

Responsibilities of the vehicle registration authority

Based on the list of expired cars, discarded cars, and cars not allowed to circulate according to the law provided by the registration agency or competent state agency, the vehicle registration agency must review and notify organizations and individuals with cars to carry out recall procedures.

Within 30 days from the date of notification, if the vehicle owner does not complete the recall procedure, the competent authority shall carry out the administrative penalty procedure according to regulations.

Update vehicle owner declaration information on the website of the Traffic Police Department or public service portal about vehicles that have expired their usage period, discarded vehicles, damaged vehicles that cannot be used, and need to go through recall procedures according to the provisions of this Circular.

Notify the list of vehicles that have expired, discarded, are not allowed to circulate, and are stolen according to the law to the police of units and localities tasked with ensuring traffic order and safety for detection and handling according to the law and notify the vehicle owner via email address, text message, or public service portal.

Vehicles that have been registered and have their license plates issued in violation of the law; vehicles that have been registered but the vehicle records are found to be falsified or there is a conclusion from a competent authority about the illegal change of the chassis number or engine number, the vehicle registration authority shall notify the vehicle owner and proceed to issue a decision to revoke the vehicle registration certificate and license plate. For vehicle records that are concluded by a competent authority to be falsified or the engine number or chassis number has been illegally cut, welded, erased, tampered with, or re-stamped, they shall be transferred to the investigation agency for clarification and handling in accordance with the law.

Responsibility of police units, localities and functional forces in charge of ensuring traffic order and safety.

Through the work of ensuring traffic order and safety, social order and safety, if a vehicle subject to the provisions of this Circular is discovered, a record shall be drawn up, handling shall be carried out in accordance with the provisions of law, and written notification shall be sent to the agency that registered the vehicle for monitoring.

Based on the list of expired cars, discarded cars, and cars not allowed to circulate according to the law provided by the vehicle registration agency, the commune police will notify the car owner or the person using the car with headquarters or residence in the area, proceed to revoke the car registration certificate, license plate and issue a revocation certificate (paper or electronic copy).

In case the commune police have not been assigned to register vehicles, they will withdraw and hand over the vehicle registration certificate and license plate to the local district police to withdraw them on the vehicle registration and management system according to regulations.

In case a vehicle is destroyed and cannot be used, the agency handling the traffic accident shall temporarily detain the vehicle registration certificate and license plate and notify in writing the agency that registered the vehicle to carry out the revocation procedures according to regulations.

Thus, the assigned commune police will have the responsibilities of being the vehicle registration agency. In addition, for cars that have expired their usage period, discarded cars, and cars that are not allowed to circulate, the commune police will notify the car owner or the person using the car with headquarters and residence in the area, proceed to revoke the vehicle registration certificate, license plate number and issue a revocation certificate (paper or electronic copy).
