Will propose to review the beneficiaries.
Recently, Lao Dong Newspaper published an article titled “Teachers in the mountainous area of Son La petition for being “forgotten” about their policies”, reflecting on the fact that many teachers in Quynh Nhai district were upset because their policies were “forgotten” when working in remote areas.
It is worth mentioning that although working in the same area, many teachers at high schools in the district have received money. In fact, nearly 1,000 teachers at all levels in Thuan Chau district (bordering Quynh Nhai district) have also received the regime. Meanwhile, teachers from kindergarten to junior high school in this district have not received it.
Regarding this issue, on November 11, Lao Dong Newspaper reporters had a meeting with leaders of Son La Department of Home Affairs to clarify the issue.
During the meeting, Mr. Nguyen Thanh Tinh - Deputy Director of Son La Department of Home Affairs - said that according to Decision No. 275 dated March 7, 2018 of the Government, Quynh Nhai district is one of the districts that escaped poverty in the period of 2018 - 2020.
However, Decree No. 76 on the implementation of policies for cadres, civil servants, public employees, workers and salaried employees in the armed forces working in areas with particularly difficult socio-economic conditions took effect from December 1, 2019. Thus, many teachers in Quynh Nhai may not be eligible for this Decree.
Regarding the proposal that high school teachers in the same area are entitled to a one-time subsidy when leaving a difficult economic and social area while other levels are not, Mr. Tinh informed that the Department of Home Affairs will request the Department of Education and Training to review the beneficiaries to ensure the implementation of a unified regime and policy in the area, ensuring fairness and compliance with the law.
Department of Education and Training speaks out
Previously, speaking with reporters, Mr. Tran Ngoc Tuan - Chief Accountant of the Department of Education and Training of Son La province - said that, based on Decree 76, some teachers from preschool to secondary school in Quynh Nhai district are still entitled to the regime.
According to the Chief Accountant of the Son La Department of Education and Training, although Decree 116 dated December 24, 2010 of the Government (regulating policies for cadres, civil servants, public employees and salary earners in the armed forces working in areas with particularly difficult socio-economic conditions) does not mention the accumulation of years of service of cadres, however, Decree 76 (the Decree replacing Decree 116) allows the accumulation of years of service.
In other words, Decree 116 requires cadres, civil servants and public employees to work for 10 consecutive years in economically and socially disadvantaged areas to receive a one-time subsidy.
As for Decree 76, the beneficiaries are those who are working and have actually worked in areas with particularly difficult economic and social conditions for 10 years or more. When transferring to work out of a difficult area, retiring or the place of work is decided to no longer be a difficult area, they are entitled to a one-time subsidy calculated based on the actual working time.
Article 13 of the above Decree also stipulates that the actual working time in areas with particularly difficult economic conditions is the total working time with compulsory social insurance contributions. If there is a period of interruption without enjoying social insurance benefits, it will be accumulated.
“Based on the working time in a particularly difficult area of 10 years or more, the regime is enjoyed. Whatever the state policy is, the workers must be paid accordingly. I affirm that the Department paid correctly for many high school teachers in Quynh Nhai district. Before making the payment procedures for the teachers, the Department reviewed very carefully,” said Mr. Tuan.
