Sending a question to the Ministry of Health, reader N.V.N said: "I graduated as a general practitioner in 2019, working at a specialized hospital under the Ministry of Health. I do not have a medical practice certificate.
I would like to ask, if the basic specialized training certificate and 18 months of practice are eligible for a new specialized practice license? If so, does the practice period require determination according to the basic specialized training period?
In case the above form is not newly granted, with the current regulations, what conditions are required for qualifications and practice to be granted a specialized practice certificate?
Regarding this issue, the Ministry of Health responded as follows:
According to the provisions of Clause 2, Article 125 of Decree No. 96/2023/ND-CP dated December 30, 2023 of the Government, detailing a number of articles of the Law on Medical Examination and Treatment:
"2. In case after being granted a practice license as prescribed in Point a, Clause 1 of this Article or having a practice certificate issued before January 1, 2024, if that person continues to study a specialty:
a) In case of being granted a specialized degree, a dossier can be prepared to request adjustment of the practice license to the scope of specialized practice without having to practice;
b) In case of being granted a basic specialized certificate, the specialized practice corresponding to the specialty that has been trained must be recorded on the basic specialized certificate until the total training period of the basic specialty and the practice period is 18 months (determined according to the time of starting basic specialized training). After completing the practice, a dossier will be prepared to propose adjusting the practice license to the scope of specialized practice;...".
Thus, currently, if you want to be granted a specialized practice license, you must have a practice certificate/performance license, then study a specialized degree or a basic specialized certificate and practice a specialized specialty corresponding to the specialty you have been trained in, recorded on the basic specialized certificate, until the total basic specialized training period and the practice period are 18 months (determined according to the time of starting basic specialized training).
According to the Law on Medical Examination and Treatment 2023, the authority to issue a new medical examination and treatment practice license is regulated as follows:
- The Ministry of Health grants new practice licenses for the titles of doctors, nurses, nurses, midwives, medical technicians, clinical nutritionists, outpatient emergency doctors and clinical psychologists for those working at medical examination and treatment facilities under its management authority;
- The Ministry of National Defense issues new practice licenses for the titles of doctors, nurses, nurses, midwives, medical technicians, clinical nutritionists, out-of-hospital emergency doctors and clinical psychologists for those working at medical examination and treatment facilities under its management authority;
- The Ministry of Public Security grants new practice licenses for the titles of doctors, nurses, nurses, midwives, medical technicians, clinical nutritionists, out-of-hospital emergency workers and clinical psychologists for those working at medical examination and treatment facilities under its management authority;
- The specialized health agency under the Provincial People's Committee shall issue a new practice license for the professional titles specified in Clause 1, Article 26 of the Law on Medical Examination and Treatment 2023, except for the cases specified in Points a, b and c, Clause 1, Article 28 of the Law on Medical Examination and Treatment 2023.
