The address of the facility declared on the Declaration Form is incorrect or the facility has changed its address/business location but has not notified or updated the competent authority because some documents and decisions to revoke the receipt number of the Declaration Form... sent by the Department of Drug Administration to these facilities were returned by the public postal express delivery unit.
When conducting post-inspection of cosmetics business at establishments, it was found that some establishments had changed their business locations, changed the company's legal representative, changed contact phone numbers but did not announce them to the competent authorities, causing difficulties in finding the headquarters to work with the company and wasting time.
The inspection teams had to ask relevant local authorities for assistance in identifying and searching for the business location of the facility and the phone number of the company's legal representative.
In addition, some organizations and individuals responsible for bringing products to market have not kept complete cosmetic product information files (Product Information File - PIF) at the address of the organization or individual responsible for bringing products to market and presented them to inspection and examination agencies when requested.
To effectively carry out post-market inspection of cosmetics, ensure safety and benefits for consumers, the Drug Administration of Vietnam requests the Department of Health of provinces and centrally-run cities to continue to strengthen the implementation of inspection and examination of the implementation of legal regulations on cosmetics management for cosmetics manufacturing and trading enterprises in the area.
Focus on checking and inspecting the implementation of cosmetic recall notices according to regulations, production and trading of cosmetics at incorrect addresses, and businesses changing business addresses without reporting to management agencies.
Regularly and proactively coordinate closely with the local Steering Committee 389, the Market Management Department and relevant functional agencies in the area to strengthen the inspection and examination of cosmetics circulating in the market.
In particular, focusing on inspecting the production and trading of cosmetics on e-commerce trading floors and social networking platforms TikTok, Zalo, Facebook, YouTube ... to promptly detect and handle illegal production and trading of cosmetics, suspected counterfeit cosmetics, cosmetics in circulation that have not been granted a receipt number for the Declaration Form, cosmetics of unknown origin; advertising cosmetics with features and uses that exceed the inherent features and nature of the product, inconsistent with the announced features and uses of the product.
Strictly handle and punish organizations and individuals who violate the current regulations on production and trading of cosmetics. Recall and destroy all types of cosmetics suspected of being fake, cosmetics of unknown origin, cosmetics of poor quality, and cosmetics that are unsafe for users.
The Drug Administration of Vietnam requires that cosmetics are only allowed to be put into circulation when they have been granted a Cosmetic Product Declaration Receipt Number by a competent state management agency and must be fully responsible for the safety, effectiveness and quality of the product. The competent state agency will conduct post-market inspection when the product is circulated on the market.
