On December 20, the Investigation Police Agency, Da Nang City Police, announced that it had just issued a decision to prosecute the case, prosecute the accused and temporarily detain Huynh Thi Thanh H. (47 years old), residing in Phuoc Ninh Ward, Hai Chau District, Da Nang City, for the crime of "Fraudulent appropriation of property". Huynh Thi Thanh H. is known by many as a "tycoon" in the real estate business in Da Nang.
Initial investigation results determined that Huynh Thi Thanh H. operates in the field of real estate investment and trading. Ms. H. established 6 enterprises to manage investment in real estate projects in the city with the aim of finding shareholders to contribute capital. However, the projects invested by H. have been completed and transferred to other companies for continued implementation.
In 2017, through social relationships, H. got to know Ms. M. (residing in Da Nang). In 2018, H. introduced to Ms. M. that he owned 5 plots of land on Le Duc Tho Street and was completing procedures to implement a project on these plots of land. Ms. M. trusted him, so in 2 years (2018 and 2020), she transferred more than 54 billion VND as capital contribution.
However, in reality, at the time of signing the capital contribution contract, H. had only paid a deposit but had not yet received the transfer, and was not yet the legal owner of the 5 plots of land mentioned above. Huynh Thi Thanh H. had also only hired a design consultant to prepare the project's architectural plan documents but had not yet carried out any procedures to apply for a license to implement the project.
After receiving money from Ms. M., Huynh Thi Thanh H. accepted the transfer of 2 plots of land on Le Duc Tho Street but immediately transferred them to another person; for the remaining 3 plots of land, H. did not continue to pay the land purchase price as agreed to the landowner, causing the land purchase deposit to also become invalid. Ms. H. did not notify Ms. M. but continued to negotiate contract appendices with Ms. M. to contribute capital to 3 projects on 5 plots of land to keep the amount of more than 54 billion VND that Ms. M. had contributed.
Based on the collected records and documents, the Investigation Police Agency of Da Nang City Police determined that Huynh Thi Thanh H.'s actions constituted the crime of "Fraudulent appropriation of property" as prescribed in Clause 4, Article 174 of the Penal Code. The case is under further investigation.
