Pursuant to Clause 2, Article 89 of the 2014 Construction Law (amended in the 2020 amended Construction Law, the 2024 Law on Urban and Rural Planning, and the 2024 Law on Electricity), the following cases are exempted from construction permits:
(1) State secret works; emergency construction works.
(2) The project of the project using public investment capital is committed by the Prime Minister, the head of the central agency of the political organization, the Supreme People's Procuracy, the Supreme People's Court, the State Audit, the Office of the President, the National Assembly Office, the Ministry, the ministerial -level agency, the Government Agency, the central agency of the Vietnam Fatherland Front and the People's Committee of the People's Committee, the President of the President of the Social Political and Social Authority.
(3) Temporary construction works as prescribed in Article 131 of the 2014 Construction Law.
(4) Works for repairing and improving the work of works or works for repairing and improving the external surface not adjacent to the road in urban areas with requirements on architectural management according to the regulations of competent state agencies; The content of repair and renovation does not change the use of the use, does not affect the safety structure of the project, in accordance with the planning under the law on urban and rural planning approved by competent state agencies, requirements on fire safety, explosion and environmental protection.
(5) Advertising works are not subject to a construction permit according to the provisions of the law on advertising; passive telecommunications technical infrastructure works according to the Government's regulations.
(6) Construction works located in two or more provincial-level administrative units, construction works along non-urban routes in accordance with the planning according to the law on urban and rural planning or planning with technical and specialized characteristics approved by competent state agencies.
(7) Construction works have been notified by the specialized agency on the notification of the results of the construction design evaluation results after the basis of eligible for construction design and meet the conditions on construction permits in accordance with the 2014 Construction Law.
8. Individual houses with a scale of less than 7 floors in urban area construction investment projects, housing construction investment projects with detailed planning 1/500 approved by competent state agencies.
9. Construction works of level 4, individual houses in rural areas with a scale of less than 7 floors and located in areas without urban planning, functional area planning or detailed construction area planning determined in district general planning, commune general planning approved by competent state agencies; construction works of level 4, individual houses in mountainous areas, islands in areas without urban planning, functional area construction planning; except for works and individual houses built in conservation areas, historical - cultural relic sites.
(10) The sea works belonging to the offshore wind power project have been assigned by competent authorities to the sea area to implement the project.
Note: The investor of the construction of works specified in (2), (6), (7), (8), 9. and (10), except for individual houses specified in (7) is responsible for sending a notice of the time of construction and construction design documents according to regulations to the local state management agency for construction management.
