The Ministry of Agriculture and Environment has just issued a decision on the development of legal documents to implement a handling plan related to the development of a 02-level government model in the field of state management of the Ministry.
Accordingly, the Decree regulating decentralization and division of authority in the land sector when organizing local governments at two levels will be developed in a shortened procedure, sent to the Ministry of Justice for appraisal before May 10, 2025 and submitted to the Government before June 1, 2025.

The leader of the Land Administration Department said that the draft decree will focus on handling the contents of decentralization and decomposition of competence in the Land Law associated with the two -level local government organization model; At the same time, amending and supplementing a number of articles of the decrees detailing the implementation of the current Land Law.
A series of government decrees will be reviewed and amended such as: Decree on land prices; Regarding compensation, support and resettlement when the State recovers land; on basic land surveys; register and issue land use right certificates, property ownership attached to land and land information systems; detailing the implementation of a number of articles of the Land Law; and detailed regulations on rice land.
The draft decree also clearly states the decentralization of the authority: People's Council, People's Committee, Chairman of the People's Committee of the commune, together with the agency with the function of land management, the commune level will assume a number of previous authorities of the district level. Particularly for land with water surfaces such as ponds, lakes and lagoons located in many communes and wards, the management competence will belong to the provincial People's Committee as prescribed in Article 188. The commune -level government will also continue to implement the authorities prescribed in the current Law.
The decision of the Ministry of Agriculture and Environment also stipulates the time to submit to the Government for decrees and decentralization in the field of agriculture and the environment when organizing the two -level local government to submit to the Government before 1.6; The Decree amending and supplementing a number of articles of decrees stipulating sanctioning administrative violations in the field of agriculture and environment will be built according to the progress of the Law amending and supplementing a number of articles of the Law on Handling of Administrative Violations.
