Removing difficulties in granting pink books to projects facing resettlement obligations

HCMC - Customers who bought houses that were formerly part of the 10% resettlement fund in commercial housing projects are being disadvantaged in terms of rights because they are not granted pink books.

According to the report of the Ho Chi Minh City Department of Construction, the city is currently facing a series of commercial housing projects that have been approved in principle since 2003 - 2005, but have not been able to issue books to home buyers due to legal problems related to resettlement obligations.

According to Decree 99/2015, to convert project goals from resettlement to commercial housing, the Ministry of Construction must be consulted. By June 2023, the Government abolished this procedure and assigned the handling authority to the provincial People's Committee.

However, the Housing Law 2024 and Decree 95/2024 stipulate that the purchase of commercial housing as a resettlement fund is no longer a binding administrative responsibility from the beginning of the project, but is implemented according to the contract mechanism between the State and the investor. The People's Committee of Son La province has just issued a decision on cases of enjoying social housing support policies in the province.

According to the decision, people with houses under their ownership but 30km or more away from the workplace (based on the shortest road) will enjoy social housing support policies.

In case of two or more houses, the distance will be calculated from the house closest to the workplace but must still ensure a minimum of 30km.

This policy applies to the subjects specified in Article 76 of the 2023 Housing Law, including low-income people, workers, civil servants, armed forces, etc.
