Mr. N.T.N.S in Can Tho reflected that he graduated from university in 2015 and has participated in construction activities for 10 years. His previous practicing certificate had a term of 5 years (2019-2024), which has now expired.
Mr. S has submitted a dossier requesting re-issuance of the Certificate of Design of Agricultural and Rural Development Works (Irrigation) class III according to Decree No. 175/2024/ND-CP.
He has declared enough 2 similar level IV projects that have been implemented, but the dossier review unit believes that these 2 projects implemented in 2024 did not have enough experience time of 2 years, while he has participated in construction activities for a long time and implemented these projects when the old certificate was still valid.
Mr. S asked, is the dossier review unit's refusal to issue certificates as above in accordance with Decree No. 175/2024/ND-CP or not?
Regarding this issue, the Ministry of Construction has the following opinions:
According to the provisions of Clause 3, Article 82 of Decree No. 175/2024/ND-CP, the professional experience conditions to be granted a construction design practicing certificate are:
Grade III: Has participated in designing or appraising construction designs of work items under the content of requesting practicing certificates for 03 projects from level III or higher or 05 projects from level IV".
Accordingly, in the case where you declare 2 level IV works, you have not met the conditions according to the above regulations.
