The Ministry of Agriculture and Environment received a petition from voters of Lam Dong province with the content: Voters of Dam Rong 3 commune proposed to soon issue a decision to replace Decision No. 326/QD-TTg dated March 9, 2022 of the Prime Minister on allocating national land use planning targets for the period 2021 - 2030, vision to 2050 and the 5-year national land use plan 2021 -2025 so that localities have a basis for issuing Certificates of Land Use Rights to the people.
Regarding this proposal, the Ministry of Agriculture and Environment reports as follows: Implementing Resolution No. 174/2024/QH15 dated November 30, 2024 of the National Assembly, which includes the content approving the policy of allowing adjustments to the National Land Use Plan and the tasks assigned by the Government, the Ministry of Agriculture and Environment has organized the implementation of adjusting the National Land Use Plan for the period 2021-2030, vision to 2050 to report to the Party Committee of the Government and the Government. The Party Committee of the Government has submitted Official Dispatch No. 24-TTr/ĐU dated April 18, 2025, reporting to the Politburo on adjusting the National Land Use Plan.
Implementing the direction of the Politburo in Official Dispatch No. 14566-CV/VPTW dated April 26, 2025, the Ministry of Agriculture and Environment has advised the Government to issue Resolution No. 66. 3/2025/NQ-CP dated September 15, 2025 on removing and handling obstacles to implement projects during the National Land Use Plan period 2021 - 2030, vision to 2050 that has not been approved for adjustment, in which Clause 1, Article 2 stipulates:
“1. Based on the Provincial Plan for the period 2021 - 2030, vision to 2050 approved before July 1, 2025, the People's Committees of provinces and cities allocate land use targets to commune-level administrative units after arrangement to carry out land management work in localities without being bound by national land use planning and plans targets that have been allocated according to Resolution No. 39/2021/QH15 dated November 13, 2021 of the National Assembly on National Land Use Plan for the period 2021 - 2030, vision to 2050, national land use plan for 5 years (2021 - 2025). ”
According to the above regulations, localities are based on land use targets in provincial planning allocated to commune-level administrative units after arrangement to carry out land management work (including the issuance of land use right certificates) without being bound by national land use planning and plans targets allocated by the Prime Minister in Decision No. 326/QD-TTg dated March 9, 2022.
Therefore, it is proposed that the Delegation of National Assembly Deputies of Lam Dong province notify voters of Dam Rong 3 commune to know and contact the local land management agency to be guided and resolve the issuance of land use right certificates according to their authority and legal regulations.
