In March 2026, Vice Chairman of Khanh Hoa Provincial People's Committee Tran Hoa Nam just signed a decision on authorizing commune-level People's Committees and Chairmen of commune-level People's Committees to perform a number of state management tasks on land in the area.
According to this decision, the Provincial People's Committee authorizes the Commune-level People's Committee to decide on other measures and levels of support for each specific project according to the provisions of the 2024 Land Law and Decree 88/2024/ND-CP of the Government.
In addition, the Chairman of the Commune-level People's Committee is authorized to perform 41 state management tasks on land in the area.
Some notable tasks include: Approving agricultural land use plans of economic organizations; approving rice land use plans of individuals.
The Chairman of the commune-level People's Committee is also entitled to decide on land recovery, issue land recovery notices; approve compensation, support and resettlement plans; approve coercive plans to implement land recovery decisions and funds for coercive activities.
In addition, the commune level is authorized to decide the land price and the selling price of resettlement housing in the area; re-determine the area of residential land and issue certificates of land use rights and ownership of assets attached to land according to regulations.
Some other tasks include: deciding to establish a land valuation council; deciding to allocate land, lease land, and allow land use purpose conversion for individuals; deciding to allocate land to residential communities.
In addition, the Chairman of the commune-level People's Committee is authorized to resolve land disputes between households, individuals and residential communities; issue decisions to resolve disputes and decisions to enforce the implementation of decisions to resolve land disputes according to regulations.
Some other tasks include issuing decisions to allocate land to eligible individuals; approving land use right auction plans; having documents approving or not approving agricultural land use plans; approving plans to contribute land use rights of individuals.
Chairmen of commune-level People's Committees are also allowed to decide to recover land in cases such as: Ending land use according to legal regulations; land users voluntarily return land; land that is at risk of threatening human life or is no longer capable of continued use...
This authorization is carried out in accordance with the provisions of Article 14 of the 2025 Law on Organization of Local Government. The authorization period is extended until the Provincial People's Committee has a document terminating it.
In addition, while the province has not issued regulations on procedures and administrative procedures for land according to Decree 49/2024/ND-CP, commune-level People's Committees and Chairmen of commune-level People's Committees continue to perform the assigned tasks, and at the same time apply procedures and administrative procedures for land according to the provisions of law before this decree takes effect.
