Based on Clause 7, Article 4 of Decree 102/2024/ND-CP, it is stipulated as follows:
Article 4. Detailing the type of land in the agricultural land group
7. Other agricultural land includes:
a) Incubation land for seedlings, breeds and land for growing flowers and ornamental plants; land for cultivation, animal husbandry, and aquaculture for learning, research, experimentation, and experimental purposes;
b) Land for building greenhouses and other types of houses for the purpose of cultivation and animal husbandry, including forms of cultivation and animal husbandry not directly on land;
c) Land for building works associated with agricultural production areas including land for building guesthouses, shacks, camps to serve workers; land for building works to preserve agricultural products, store pesticides, fertilizers, machinery, tools and other auxiliary works.
Based on point a, clause 1, Article 218 of the 2024 Land Law, it is stipulated as follows:
Article 218. Multi-purpose combined land use
1. The following types of land are used in combination for multiple purposes:
a) Agricultural land used in combination with commercial, service, livestock, and medicinal plant purposes;
2. The use of land combined with multiple purposes must meet the following requirements:
a) Does not change the type of land according to the land classification specified in Clauses 2 and 3, Article 9 and has been identified in the types of documents specified in Article 10 of this Law;
b) Not to lose the necessary conditions to return to using land for the main purpose;
c) Not affecting national defense and security;
d) Limiting the impact on the conservation of natural ecosystems, biodiversity, and environmental landscapes;
e) Not affecting the land use of adjacent land plots;
e) Fully fulfill financial obligations as prescribed;
g) Compliance with relevant laws.
Accordingly, based on the above regulations, works built on agricultural land include:
- Land for building greenhouses and other types of houses for the purpose of cultivation and animal husbandry, including forms of cultivation and animal husbandry not directly on land;
- Land for building works associated with agricultural production areas including land for building guesthouses, shacks, and camps to serve workers; land for building works to preserve agricultural products, store pesticides, fertilizers, machinery, tools and other auxiliary works.
In addition, agricultural land is used in combination with commercial, service, livestock, and medicinal plant purposes. However, the use of land combined for multiple purposes must meet the following requirements:
(1) Does not change the type of land according to the land classification specified in Clauses 2 and 3, Article 9 of the 2024 Land Law and has been identified in the types of documents specified in Article 10 of the 2024 Land Law;
(2) Not to lose the necessary conditions to return to using land for the main purpose;
(3) Not affecting national defense and security;
(4) Limiting the impact on the conservation of natural ecosystems, biodiversity, and environmental landscapes;
(5) Not affecting the land use of adjacent land plots;
(6) Fully fulfill financial obligations as prescribed;
(7) Compliance with relevant laws.
