On the Ministry of Construction's Information Portal on November 10, citizen N.D.P reported that according to the Law on Urban and Rural Planning applied from July 1, 2025; in the case of a land plot with an area of about 300m2 located in an area with a zoning plan of the city.
Thus, citizens who want to build a hotel must follow the master plan or detailed planning or locally adjust the planning?
The Department of Planning and Architecture, Ministry of Construction has the following opinion:
Article 8 of the Law on Urban and Rural Planning (Law No. 47/2024/QH15) stipulates that urban and rural planning is the basis for establishing construction investment projects, ensuring the suitability of construction investment projects for each type, level of urban and rural planning, and specific urban design, detailed in Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Construction Law on construction management.
The cases of detailed planning are specifically regulated in Clause 6, Article 3 of Law No. 47/2024/QH15 and Article 9 of Decree No. 178/2025/ND-CP dated July 1, 2025 of the Government detailing a number of articles of the Law on Urban and Rural Planning.
Land plots that meet the requirements in Clause 3 and Clause 5, Article 10 of Decree No. 178/2025/ND-CP dated July 1, 2025 of the Government will have detailed planning prepared according to a shortened process (called the process of establishing "general planning".
The local adjustment of urban and rural planning is carried out when ensuring the conditions for planning adjustment as prescribed in Article 45 of Law No. 47/2024/QH15.
